ANNOUNCEMENT:
The Condobolin Sports Promotion, hereafter called the PROMOTER will conduct SLATTERY AUCTIONS
CONDO 750 for senior solo motorcycles, quads and sidecars at Condobolin in the Lachlan & Cobar Shires on the
10th, 11th and 12th April 2015.
2.
JURISDICTION:
2.1. The above-mentioned meeting has been authorised by Motorcycling NSW Limited (MNSW) who has issued
the Motorcycling Australia Permit Number 3/15/61035 and is open to holders of current Motorcycling
Australia National Competition Licences.
2.2. The meeting will be held in accordance with the current General Competition Rules (GCR’s), these
Supplementary Regulations, the By-Laws of MNSW and any Final Instructions.
BY ENTERING THIS MEETING ALL PARTIES AGREE TO COMPLY WITH THESE RULES,
REGULATIONS, BY-LAWS AND INSTRUCTIONS.
3.
ENTRIES:
4.1
Entries open 1st March 2015 and close last mail 1st April 2015.
3.2
The organizers reserve the right to cancel or postpone the event if fewer than 30 entries are received by the
entry date.
3.3
Entries will be accepted in order of receipt.
3.4
Late entries may be accepted at the organizers discretion and will attract an additional fee of $50.00 which
will apply to all late entries. The organizers reserve the right to refuse or reject any entry (GCR).
3.5
In the case of postponement or abandonment of the meeting, all or any part of the entry fee may be retained
by the Promoter, if such retention is approved by MNSW.

3.6
Only entries received on the official Entry Form that are accompanied by the correct fee to the organiser’s
official address will be accepted.
3.7
NOTE: LATE ENTRIES MAY BE ACCEPTED OR REJECTED AT THE DISCRETION OF THE RACE
SECRETARY, AFTER CONSULTATION WITH THE RACE COMMITTEE OR CLUB EXECUTIVE
COMMITTEE, AND THE RETURN OF ENTRY FEES FOR ANY RIDER WITHDRAWING FROM THE
MEETING IS AT THE DISCRETION OF THE PROMOTER, BEFORE ENTRIES CLOSE. ANYONE
WITHDRAWING FROM THE EVENT AFTER THE CLOSE OF ENTRIES WILL INCUR A PENALTY FEE.
3.8
The motorcycle must have a current full road registration or approved RTA “Unregistered Vehicle Permit”.
Proof of registration must be provided at sign on & scrutineering.
4.
INSURANCE:
4.1
National Capital Benefits Scheme provides basic cover for death and permanent disability.
4.2
Personal Accident and Ambulance Insurance is the responsibility of the individual.
4.3
IT IS STRONGLY RECOMMENDED THAT COMPETITORS GIVE DUE CONSIDERATION TO
TAKING OUT SUCH INSURANCE COVER.
4.4
Motorcycle Third Party Insurance and or Third Party Property Insurance and or Comprehensive Motorcycle
Insurance are the responsibility of the entrant.
5.
MEDICAL SERVICES:
St John’s First Aid Service will be available.
The medical services will operate from Friday afternoon 10th April to completion of event Sunday 12th April 2015
6.
ENTRY FEE:
6.1 $450.00 per entry including 1 set Service Crew instructions – Service crew MUST be registered with
organisers.
6.2 Unregistered Vehicle Permits MUST be obtained by competitors.

Trophies will be awarded as follows:
A trophy will be awarded to the 1st, 2nd and 3rd placed outright winning riders.
A trophy will be awarded to the 1st, 2nd and 3rd placed rider in each class. ie. H1, H2, H3, Quads, Masters &
Sidecars.
A trophy will also be awarded to the 1st placed outright 2 stroke rider.

Nominations for the following classes shall be accepted and competitors shall nominate their class at the
time of entry.
H1:

Any number of entries shall constitute a class at the Promoters decision.
Changes in class shall be notified to the Race Secretary prior to the start of the event
Should there be insufficient entries in any Class of Competition, the decision to run or cancel the Class, or to
combine classes and re-distribute any awards, will be at the discretion of the Promoter, subject to MNSW
approval.
10.
RESULTS:
10.1 Results will remain “Provisional” until ratified and confirmed by MNSW.
11.
MACHINES AND RIDERS:
11.1 All machines entered must comply with the current GCR’s for Enduro Competition.
11.2 Multiple entry of the one Machine in the same Class of Competition is not permitted.
11.3 Eligibility of rider: The competitive class will be an open competition for competitors who hold a current
Motorcycling Australia Senior National Licence. Furthermore all competitors are required to hold a current
Drivers Licence of a class suitable for use of motorcycles on public roads. The meeting will be held in
accordance with the 2015 General Competition Rules (GCR’s) and these supplementary regulations, the ByLaws of Motorcycling NSW and any final instructions.
11.4 Eligibility of Machine: All motorcycles must be roadworthy and hold a current registration or an appropriate
RTA “unregistered vehicle permit” for riding on public roads within New South Wales, and be covered by a
Compulsory Third Party (CTP) Insurance Policy valid in New South Wales. Proof of registration must be
presented at documentation (sign on) and scrutineering. A number plate is NOT proof of registration. Off
road permits and rec rego permits issued by other states will not be accepted. Unregistered vehicle
permits must be obtained by competitors.
The one and same motorcycle must be used throughout the event and must be ridden only by the nominated
rider at all times. Another competitor or other person may if necessary remove the motorcycle from a
position of imminent danger. The said person may ride the motorcycle, only so far as to remove it from the
dangerous position.
11.5 The engine capacity of any motorcycle must not exceed 1000cc. A tolerance over and above the class
capacity shall be permitted for each class, as set out at GCR 17.17.2
11.6 Noise &/or Fuel Testing may be carried out at any time during this meeting.
RIDING NUMBERS:
11.7 Competitors will be allocated their MNSW Registered Enduro Riding Number or their preferred Riding
Number if available. All others shall be allocated numbers at the discretion of the organisers.
11.8 The competitors are to supply white backgrounds and event motorcycle identification numbers in
black, as assigned by organizers. Numbers will be assigned in order of entry receipt. Number size is as set
out GCR 17.12.
11.9 Identification to be affixed to the motorcycle as follows. A forward facing white number plate and two (2)
side number plates 200mm wide x 200mm deep.
11.10 All Number Plates on all Machines MUST comply with the GCR’s.
12.
START ORDER:
The start order for the first day shall be determined by seeding. The start order Leg 1 will be announced
immediately after briefing on Saturday 11th April 2015.
The starting order for the second day shall be in order of ascending total penalty times within descending numbers
of sections competed on the first day. Where there is a tie the Clerk of Course will determine which bike starts first.
NB. If dusty conditions prevail, the Clerk of Course may determine that Quads be seeded behind Classes H1, H2,
H3& over 45 class with an extra time gap.
The Clerk of Course reserves the right to seed any riders at any time before or during the event.

RIDERS BRIEFING:

A Riders’ Briefing will be held at 6am on Saturday 11th April 2015 ALL Competitors and service crew MUST
attend. Riders’ Briefing Sign On sheets must be signed by the competitor and service crew as confirmation of
attendance. Attendance is compulsory and a competitor may be excluded from the event for non-attendance.
14.
DRUG AND OR ALCOHOL TESTING:
By order of MNSW, random drug &/or alcohol testing of participants (i.e. officials, competitors, mechanics, pit
crew and any other person associated with the control, direction and operation of the competition) may take place
prior to, or at any time during this meeting.
15.
CODE OF CONDUCT:
All Competitors, Officials, Parents, Service Crews and Support Persons are reminded of the Motorcycling Australia
By-Law - CODE OF CONDUCT (as stipulated in the GCR’s) which is a guide to appropriate behaviour at all
Motorcycle Race Meetings. This CODE OF CONDUCT applies to this Meeting and shall be enforced.
Riders are reminded that they are responsible for the conduct of their Service Crews and Support Persons.

17.
CIRCUIT DESCRIPTION:
The event will consist of three (3) days and be approximately 750 kilometres in total length, conducted over a
variety of terrain on private and public roads and tracks. A day will consist of a number of sections (both ‘selective’
& ‘road’) between specified control points.
a)
SELECTIVE SECTION will be a competitive section on private property with a time allowed by
the organisers for late time purposes. Time taken in excess of time allowed will be applied against late time limit.
All selective sections will be conducted on private property.
b)
ROAD (TRANSPORT) SECTION will be non-competitive and take competitors from one
selective section to another and will be on main road where other road users may be expected. Time taken in excess
of the time allowed (to the current minute) will be applied against the late time limit as well as penalty time – refer
timing.
18.
STARTS:
18.1 Competitors will start at 1minute intervals from Condobolin Showgrounds at 0630 hrs on Saturday 11th
April 2015.
18.2 Competitors will start at 1minute intervals from Condobolin Showgrounds at 0730 hrs on Sunday 12th April
2015.
18.3 The start Order will be announced at 0600hrs on Saturday 11th April and 1900 hrs on Saturday 11th April
2015, for Sunday start order
19.
RACING
Racing will be held over 2 days with 6 selective sections, 3 on Saturday and 3 on Sunday Approx total
Competitive 750klm.

20.
NOISE:
20.1 All machines must comply with the requirements of the GCR’s and the Track Licence.
The noise limit for this event is 94dbA – all motorcycles.
20.2 Any competitor whose machine due to damage or loss of components ceases to comply with the Road Traffic
Act may be required to withdraw from the event.
21.
GST:
Income is exempt from tax under subdivision 50A of the Income Tax Assessment Act 1997 and therefore the Promoter
does not need to quote an ABN and you do not need to withhold tax. For the purpose of GST the Entry form will
become the Tax Invoice.

22.2 SCRUTINEERING
All competing motorcycles will be required to be presented to the organisers on Friday 10th April 2015
between 1700 hours & 2200 hours at Condobolin unless other arrangements are made with the organisers.
.Motorcycles must be presented in a “ready to start” condition along with the rider, their approved helmet and
protective clothing. Any competitor not satisfying the scrutineers as to the suitability and safety of their
equipment will have to rectify the problem before being allowed to take the start line.
22.3 DOCUMENTATION
Competitors must produce at pre-event scrutineering:
a)
MA national competition licence.
b)
Rider’s civil riding licence.
c)
RMS (formerly RTA) registration papers or valid RMS (formerly RTA) “Unregistered Vehicle Permit”
allowing use of the motorcycle during course of the event. A number plate is NOT proof of registration.
Off road permits and rec rego permits issued by other states will not be accepted.
d)
Competitors MUST apply for their own “Unregistered Vehicle Permit” (UVP).

22.4 COMPULSORY EQUIPMENT FOR MACHINES AND RIDERS
All machines entered must comply with the current GCR’s for Enduro and Reliability Trials and Cross
Country Navigational Event.
In addition side cars MUST comply with GCR 15.23.
Multiple entry of the one Machine in the same Class of Competition is not permitted
Regardless of the minimum requirements of RTA “Unregistered Vehicle Permits” all motorcycles must be
fitted with an effective headlight and tail light and stop light powered by the motorcycle electrical system.
Battery powered or total loss systems are not acceptable.
All quads and side cars MUST be fitted with an effective “cut off” lanyard. Quad and side car riders
must at all times during the event have the lanyard secured to the rider.
All riders and sidecar passengers to wear protective clothing as approved by MA in GCR’s 25.1 for use
in Enduro & Reliability Trials.
All riders and sidecar passengers must wear a safety helmet at all times when the motorcycle is in
motion and be in good condition as per GCR’s.

All machines must be fitted with an effective map reader. Route instructions will be printed on paper 145mm
wide to suit standard “Acerbis” map reader, which is commercially available.
22.5 OPTIONAL EQUIPMENT
Motorcycles entered may fit the following equipment:
a)
Navigational equipment and additional instruments may be fitted.
b)
Fuel for at least 125 km will be required to be carried on the motorcycle. The existing fuel tank may be
replaced or enlarged. Supplementary fuel tanks may be fitted providing such tank meets the safety
requirement of the organisers. SPLASH AND DASH DETAILS WILL BE LISTED IN FURTHER
REGULATIONS
c)
Competitors are encouraged to carry UHF hand held radios. For the use in emergency circumstances.
22.6 DURING EVENT SCRUTINEERING
During the event scrutineers appointed by the organisers may set up monitoring controls at which checks for
safety and general compliance with the regulations may be undertaken. LANYARDS on quads and sidecars
will be inspected and MUST be attached to the rider – penalties will apply if lanyards are not attached to the
rider. As well, Particular attention will be paid to faulty exhaust systems and mufflers spark arresters, or other
defects likely to cause grass fires. Any motorcycle found to be non-roadworthy by the Police Department or a
relevant RTA officer will be liable for exclusion.
22.7 IMPOUND
All motorcycles are to be placed in impound at the Condobolin Showground immediately following the
completion of Day one (1). Servicing is to be carried out in the impound area and no motorcycle may be
removed from the impound without written permission of the Clerk of Course. The penalty for removal of a
motorcycle without permission is exclusion.
You may remove your motorcycle from the impounded area 30 minutes after the last competitor has arrived
unless otherwise advised.
Riders are not permitted to wash their bikes on the oval impound area
22.8 ROUTE INSTRUCTIONS
The organisers will provide each competitor with a copy of the route instructions in scroll form and any
special maps needed the night before each day.
Leg1 (Saturday) instructions will be issued at scrutineering Friday 10th April 2015.
Leg 2 (Sunday) instructions from 1800 hrs Saturday11th April 2015..
Any alterations to the schedules or route instructions will be in writing, generally posted on the official
noticeboard.
The organisers reserve the right to abandon, alter or postpone the event should in the opinion of the
organisers the course or any part thereof becomes impassable.
22.9 CONTROLS
The location of Major Controls (start and finish of sections) will be disclosed in the route instructions.
Passage Controls within competitive sections may or may not be specified in the route instructions.
Controls will remain open until the arrival of the sweep vehicles.
Sweep vehicles will follow the last recorded competitor.
Control Signs at the Start of a selective section will be laid out as follows:

Yellow warning sign with clock approx. 25 metres from control point,
b)
Red sign with clock at control point,
c)
Red sign with flag marking the start of the selective section, and
d)
Red sign with diagonal bars indicating end of control zone,

Control Procedure Start Of Selective Section
a) At the finish of a road section, the control official will enter the actual check-in time of the competitor on the
time card. Remember! The check in time is either the time the bike enters the control zone (i.e. passes the
yellow “clock board “) or the time when the card is handed to the control official, which ever is the sooner.
See diagram ‘Start Control’ following.
b) The competitor will be provided with a start time for the selective section, which will be three (3) minutes
after the actual check-in time of the road section.
c) The competitor moves to the start line where he will be started at the exact minute following a countdown by
the official.
d) Intervals between successive bikes will be a minimum of one (1) minute.

Control Procedure Finish Of Selective Section
The control official will record the flying finish time of the competitor as he passes the red chequered flag.
See diagram ‘Finish Control’ following.
b) When the competitor stops at the control point the flying finish time is recorded on the time card.
c) The control official then enters the start time for the next road section. This is the competitors flying finish
form but with the seconds disregarded (e.g. Finish= 15.23.45, then start = 15.23)
d) The competitor leaves at once. There is no countdown.
a)
Passage Control
In order to check that the competitors are on the correct route, passage controls may be set in place. The route
instructions may specify their exact location. These locations will be identified by:
a)
yellow sign with stamp about 100 meters before the passage control point,
b) red sign with stamp - competitors will be held long enough to have identifying stamp recorded on their time
cards, and
c)Beige diagonal stripes (end control).

22.10
SELECTIVE SECTIONS
Selective sections are speed tests.
a) Competitors are forbidden to drive in the opposite direction to that of the official route under pain of
penalties, including exclusion.
b) It is extremely dangerous to slow down or to stop between the yellow warning sign, the red chequered flag at
the flying and the red stop at the control point. Competitors stopping in this “banned” area may be penalised
up to exclusion.
22.11
GATES
All gates on the course will be marked and are to be dealt with as follows:
BLUE MARKER: gate should be open and left open by the competitor.
YELLOW MARKER: gate should be closed and must be closed by the competitor after passing through.
The only exception to this rule is when two (2) or more competitors are close together and the last competitor in
the group signals their intention to close the gate to the first member of the group. Failure to close a gate may
render a competitor liable to penalty including exclusion.
PRE WARNING YELLOW GATE signs will be used in the event and will be placed approximately 100– 150
metres prior to the gate. Remember all yellow gates MUST be closed by competitors.

24.12 PRE- CAUTION WARNING
Pre caution warning signs will be used in the event and will be placed approximately 100 – 150 metres prior to!!!
CAUTION (TRIPLE CAUTIONS) which are unsighted from the road i.e. over the crest / around corner.
The sign will be Yellow Diamond with Black!

24.13 TIMING
a)
Timing will be by official timepieces set to Australian Eastern Standard Time. No protest shall lie against the
alleged inaccuracy of any timepiece.
b)
For selective sections, finish time will be recorded to the nearest second at the Red flying finish marker.
c)
Timing of road sections will be to the current minute.
d)
If a competitor chooses not to compete in a section (for whatever reason) they may elect to miss that section
but will have to miss all subsequent sections of that day. The competitor will incur the maximum penalty for
missing a section or sections, equal to 200% of the “time allowed” for that section. The competitor may
rejoin the event at the start of the next day.
e)
If a competitor chooses to “cut & run” they must report their intention to the major control at the beginning
or end of the section from which they are withdrawing. Failure to report the intention to “cut & run” will
result in exclusion.
f)
Results will be calculated by adding competitors’ selective times plus any penalties to get a total penalty
time. The winner of the event shall be deemed to be the competitor with the lowest overall penalty time
assuming all sections have been successfully completed.

TIME CARDS
At the start of the event competitors will be handed a time card on which the time allowed to cover each
section will appear. The time card will be handed in at the finish control at the end of each section and
marked prior to continuing. Each competitor is solely responsible for his/her time card.
Any correction or amendment made to the time card by anyone other than a control official will result in
exclusion.
The competitor alone is responsible for submitting the time card at different controls and for the correctness
of the entries.
The control officials are the only people permitted to enter times on the cards.
If a competitor’s card does not have the required stamps from any passage controls or the competitor fails to
hand in their time card at any control, or fails to report to any control then it will be assumed the competitor
has not completed that section and a penalty of 200% of the time allowed for that section will apply.
If a competitor losses their time card a penalty of 30 minutes will be applied. The loss of a card should be
reported to the next control and the competitors’ time marked on the control official’s sheet.

24.15 ODOMETER CHECK
The 5 km mileage check is located on the Forbes Road, south of the showground. The check is marked 0-1-2-3-4-5.
The survey vehicle recorded 5.00km over the measured 5km.
24.16 LATE TIME
The late time limit for each leg will be two (2) hours or as advised in the route instructions, and will be marked on
each competitor’s time card. If a competitor exceeds late time for a section, he will be excluded from the results of
that section, but may if he wishes re-start a subsequent leg.
a) Late time is the accumulated time by which a competitors is late (i.e. exceeds the time allowed for road or
selective sections). Late time is calculated from the beginning of a section excludes time held in control and any
allowable time, and is non-cumulative from one leg to another. (Allowable time is any potential penalty, which
is not imposed by the Organisers for good and sufficient reasons such as compassionate allowance etc.).
b) Competitors exceeding the late time limit at a major control will be deemed to have missed that control and the
following controls within that leg. Late time cannot be regained by booking in early at any control.
24.17 COMPASSIONATE TIME REFUND
Upon arriving at the scene of an accident it is a competitor’s duty to ensure that any injured riders are being looked
after and that further assistance is not required before continuing on. All refunds of compassionate time for stopping
to assist at an accident shall be determined by the Clerk of Course. Requests for compassionate time refund must
be lodged in writing to the Clerk of Course or Race Secretary with the number of the bike involved and
location of the accident.
24.18 OVERTAKING
A competitor about to be overtaken must allow the overtaking motorcycle to do so immediately by moving to the side
of the track and if necessary slowing or stopping.
At any control a competitor may request that another competitor be permitted to start ahead provided there is not more
than two (2) minutes between the competitors being booked into the control.
The official in charge of the control may grant this request.
Should a competing motorcycle be obstructing the course, a following competitor may request and must be given
assistance to pass unless the rider of the obstructing motorcycle is incapacitated through injury.
Any competitor reported to the organisers for deliberately balking, obstructing or shunting another competitor may be
subject to exclusion from the event.
24.19 SERVICE CREWS
Service crews MUST be registered with the organisers at sign on and only registered service vehicles will be
permitted in the service areas and the overnight impound at the Showground. Additional Service Crew $15.00 per
crew.
Service vehicles may not enter any control area and must only use the roads specified in the service crew instructions.
Servicing is only permitted in the nominated service and refuelling locations. Service crews observed outside these
areas or accessing the course other than at those points nominated in the instructions will render the entrant liable to a
penalty up to and including exclusion from the event.
24.20 ACCIDENTS
For legal purposes any accident which involves death or injury to stock and /or damage to property (including fences
&gates) must be reported to the organisers as soon as possible on an accident sheet, failure to report such an incident
may result in the competitor being penalised 60 minutes per incident. Failure to report an accident involving a
member of the public may result in exclusion.
24.21 REFUELLING
ALL SERVICE CREWS MUST HAVE A MINIMUM 1KG FIRE EXTINGUISHER AT EACH
REFUELLING / SERVICE AREA including impound area.
Motorbike engines will be switched off during refuelling as per GCR.
All riders and sidecar passengers must be dismounted prior to refuelling. Penalties apply if rider and or sidecar
passenger is not dismounted
All refuelling must be done with enviro mat under motorcycle to absorb any spilt fuel. Penalties apply if enviro mat is
not used.
Fuel for at least 125 km will be required to be carried on the motorcycle. The existing fuel tank may be replaced or
enlarged. Supplementary fuel tanks may be fitted providing such tank meets the safety requirement of the organisers.
SPLASH AND DASH DETAILS WILL BE LISTED IN FURTHER REGULATIONS.
24.22 ENVIRONMENT

Enviro mat must be placed under the motorcycle when refuelling, changing oils, adjusting coolants and
applying chain oil.
Tear offs must not be used.
Riders and service crews MUST ensure that no rubbish/litter of any kind is to be left anywhere on the
course, at service areas, at Impound or any other area that is part of the event.
Enviro mats will be available at Documentation for $5.00
24.23 COMPLAINTS
Any complaints, verbal or in writing, shall be given to the Clerk of the Course. The organising committee appointed
officials including Control Officials shall not receive accept or discuss any complaint during the running of the event.
24.24 PROTESTS
Protests, if any must be lodged in accordance with the provisions of the GCR’s
All decisions of the organisers and their appointed officials shall be final.
24.25 OFFENCES/BREACHES THAT MAY REQUIRE A HEARING BY THE STEWARD
Competitors alleged to have committed the following offences may be subject to an additional penalty as the Steward
of the Event may impose (eg: fines, time penalties, exclusion from a group or class, exclusion from the Event). Such
penalties are in addition to those imposed by the Clerk of Course as per E2.

Failure to close a gate to the satisfaction of the Organiser,
Removal of a vehicle from an impound without the written permission of the Clerk of Course.

competitor is withdrawing.

2.

custodian of the Minor, whilst the Minor has entered and participates in the Event (with the Guardian's acceptance of such
appointment evidenced by their execution of this Deed below). The Guardian's appointment as Guardian under this Deed is of no
effect in circumstances where I/we (the parent or legal guardian of the Minor) is/are in attendance at the Event (and will remain of
no effect only for so long as I/we are in attendance at the Event). In those circumstances and for so long as I/we remain in
attendance at the Event, I/we retain full legal responsibility for the Minor.
3.
I acknowledge that motorcycle sport is dangerous and that by engaging in the sport and participating in the Event the Minor,
takes and is exposed to certain risks and dangers including that:
a) the Minor may be injured, physically or mentally, and may be killed;
b) the Minor’s machinery or equipment may be damaged, lost or destroyed;
c) other competitors may ride dangerously or with lack of skill;
d) track or event conditions may be hazardous and may vary without warning or predicability;
e) the Organisers, officials, landowners/track operators and any agents or representatives of those in charge of the Event
are frequently obliged to make decisions under pressure of time and/or events;
f) any policy of insurance of or in respect of the Minor’s life or physical or mental health may be voided;
g) there may be no or inadequate facilities for treatment or transport of the Minor if injured; and
h) entrants including the Minor have an obligation to themselves and to others to compete safely and within the rules of
competition.
4.
In consideration of the Organiser’s accepting the Minor as an entrant in the Event I agree to indemnify the Guardian,
the Organisers and each of them in the following manner:
a) that the Minor participates in the race meeting at my sole risk and responsibility;
b) that the Minor accepts the venue as it stands with all or any defects hidden or exposed;
c) that I indemnify and hold harmless the Organisers, their respective servants, agents or officials
against any actions or claims which may be made by the Minor or on his behalf or by other parties for or in respect of or
arising out of the Minor’s death or any injury loss or damage caused to the Minor or the Minor’s machinery or equipment
whether caused by negligence, breach of contract or in any other manner whatsoever.
5.
I release & forever discharge the Guardian and the Organisers from all Claims that I may have or may have had but for
this release arising from or in connection with this deed or from the Minor’s participation in the Event.

I declare that the Minor is medically and physically fit and able to participate in the Event.
7.
I authorise the Guardian to administer or have administered to the Minor such medical treatment as may be required

HEREBY AGREE with Motorcycling Australia Limited (“MA”) that I am by this
agreement entitled to participate in the motorcycle activity/meeting listed in
Schedule 2 (hereinafter called "the Meeting" or the “Event”) at the venue
listed at Schedule 3 (hereinafter called "the Venue") on the terms and
conditions set out in this document.
2. DEFINITIONS In this declaration:
a) “Claim” means and includes any action, suit, proceeding, claim,
demand, damage, cost or expense however arising including but not
limited to negligence but does not include a claim against a Motorcycling
Organisation under any right expressly conferred by its constitution or
regulation;
b) “Indemnitees” means and includes the persons, organisations and
bodies corporate whose names appear in Schedule 1.
c) “MA” means Motorcycling Australia Limited;
d) “State Controlling Body” (SCB) means a state or territory motorcycling
association affiliated as a member of MA;
e) “Motorcycling Activities” means performing or participating in any
capacity in any authorised or recognised Motorcycling Organisation event,
meeting or activity;
f) “Motorcycling Organisation” means and includes MA, and the MA
members (including the SCBs and affiliated clubs) and where the context
so permits, their respective directors, officers, members, servants or
agents.
3. ACKNOWLEDGMENT OF RISKS, DANGERS & OBLIGATIONS
I ACKNOWLEDGE that:
a) motorcycle sport is dangerous and that by engaging in the sport
(whether as a competitor, recreational rider, coach, official or media) at
the Meeting I take and am exposed to certain risks and dangers and am
under certain obligations as follows:
i) that I may be injured, physically or mentally, and may be killed;
ii) that my machinery or equipment may be damaged, lost or destroyed;
iii) that competitors may ride dangerously or with a lack of skill;
iv) that track or event conditions may be hazardous and may vary without
warning or predictability;
v) that organisers, officials, landowners/track operators and any agents or
representatives of those in charge of meetings are frequently obliged to
make decisions under pressure of time/or events;
vi) that any policy of insurance of or in respect of my life or physical or
mental health may be voided;
vii) that there may be no or inadequate facilities for treatment or transport of
me if I am injured;
vii) that I have an obligation to myself and to others to act safely and within
the rules and regulations of MA;
b) the Indemnitees do not make any warranty that the services at the
Meeting will be provided with due care and skill or that any materials
provided in connection with the services will be fit for the purpose for
which they are supplied;
c) to the extent that any warranty is implied it is excluded to the full extent
permitted by law;
d) have voluntarily read and understood this warning and accept and assume
the inherent risks in participating in the Event.
4. WARNING UNDER THE FAIR TRADING ACT 1999 (VIC)
Under the provisions of the Fair Trading Act 1999 (Vic) several conditions
are implied into contracts for the supply of certain goods and services.
These conditions mean that the supplier named on this form is required to
ensure that the recreational services it supplies to you are:
- rendered with due care and skill;
- as fit for the purpose for which they are commonly bought as it is
reasonable to expect in the circumstances; and
- reasonably fit for any particular purpose or might reasonably be
expected to achieve any result you have made known to the supplier.
Under section 32N of the Fair Trading Act 1999, the supplier is entitled to ask
you to agree that these conditions do not apply to you. If you sign this form,
you will be agreeing that your rights to sue the supplier under the Fair Trading
Act 1999 if you are killed or injured because the services were not rendered
with due care and skill or they were not reasonably fit for their purpose, are
excluded, restricted or modified in the way set out in this form.
NOTE: The change to your rights, as set out in this form, does not apply if
your death or injury is due to gross negligence on the supplier's part. "Gross
negligence" is defined in the Fair Trading (Recreational Services)
Regulations 2004.
For the purposes of the clause 3, “the Supplier” shall mean and include the
Indemnitees.
5. INDEMNITY AND RELEASE GIVEN TO ORGANISERS
IN CONSIDERATION of the acceptance of me as a participant in the Meeting:
a) I AGREE TO INDEMNIFY AND KEEP INDEMNIFIED to the full extent
permitted by law the Indemnitees and each of them in the following
manner:
i) that I participate in the meeting at my sole risk and responsibility;
ii) that I accept the Venue as it stands with all or any defects hidden or
exposed;
iii) that I indemnify and hold harmless the Indemnitees, their respective
servants, agents, officials and competitors against any actions, costs,
losses or claims which may be made by me or on my behalf for or in
respect of or arising out of my death or any injury loss or damage
caused to me or my equipment whether caused by negligence, breach of
contract or in any other manner whatsoever.
b) I AGREE TO RELEASE to the full extent permitted by law the
Indemnitees and each of them from all liability to me for any claim, loss,
damage, cost or expense (whether arising under statute, from
negligence, personal injury, psychological trauma, death, property
damage or infringement of third party rights or otherwise) that arises as a
result of any act, matter or thing done, permitted or omitted to be done
by me or which is in any way connected with my presence at or
involvement in the Event.
6. The release and indemnity provided by me in this declaration is in addition to,
and will not in any way limit the application of, the conditions of sale attaching to
tickets, conditions of entry, conditions of credentials or any other applicable
terms or conditions in respect of the Event.
7. A term of this release and indemnity will not apply where the term
contravenes the law of the relevant jurisdiction under which any legal action
is legitimately taken however such terms are severable and do not invalidate
the remaining terms.
8. MEDICAL
I declare that I am and must continue to be medically and physically fit and
able to participate in the Meeting. I will immediately notify MA in writing via
my SCB of any change to my fitness and ability to participate. I understand
and accept the Indemnitees will continue to rely upon this declaration as
evidence of my fitness and ability to participate.
9. I acknowledge and agree that if required, the Indemnitees (or any of them)
may arrange medical or hospital treatment (including ambulance
transportation) for me. I authorise such actions being taken by the
Indemnitees and agree to meet all costs associated with such action. I
understand it is compulsory for me to have ambulance insurance in some
form and I accept responsibility for the cost of ambulance transportation,
ambulance cover and further agree to maintain ambulance cover during the
term of my license / membership.
10. PRIVACY
I hereby consent to the collection of my personal information by the Condobolin
Auto Sports Promotions MA and the SCB in connection with my involvement at
the Event and the use and disclosure of my personal information by Condobolin
Auto Sports Promotions, and MA to other agencies and officials associated with
the Event for the purposes of conducting and managing the Event. I
understand that I may gain access to my personal information held by
Condobolin Auto Sports Promotions by contacting Condobolin Auto Sports
Promotions at PO Box 173, Condobolin NSW 2877 or MA at 147 Montague St,
South Melbourne, Victoria, 3205. I understand that if I do not provide the
personal information requested above that I may not be permitted to participate
in the Event.
11. PERSONAL HEALTH INFORMATION
I hereby agree with MA and the SCB that in consideration for my participation in
the Event that MA and the SCB may receive, collect, store and use personal
health information about me in the manner set out below:

If I am injured, become ill or die at or following the Event the party listed
at Item 8 in Schedule 1 in addition to any hospital at which I am treated
(together “my Carers”) will have health related information about me in
their possession, power and control relating to me which is subject to
obligations imposed by the Privacy Act (“my Information”) and the
Privacy Act is intended to protect my personal information;
MA and my SCB wish to collect my Information for purposes that include

MA and SCB events and of the Meeting organisers and facility providers
of MA / SCB permitted events, and generally to reduce the risks to
persons engaged in motorcycle sport; and
It is reasonable for MA and my SCB to collect, store, use and disclose my
Information in accordance with clause 11(a)(i) above and in the manner set out
in clause 11(b).
IN CONSIDERATION of my acceptance as an entrant in the Meeting I
consent and agree that MA and my SCB:
may collect and store any of my Information, including obtain my Information
from third parties including my Carers;
may use any information collected in accordance with this clause for any
purpose consistent with creating safer competition in motorcycle sport
and events held by or in conjunction with MA, my SCB, or with an MA or
SCB permit;
may disclose my Information to third parties provided such disclosure is
reasonably intended to be used for the purpose of improving safety at
events held by or in conjunction with MA, or with an MA permit provided any
such information is held by MA or my SCB in accordance with the MA
Privacy Policy.
I irrevocably authorise MA and my SCB and hereby appoint MA and my SCB
as my lawful attorneys to collect from my Carers, and I hereby direct my Carers
to provide to MA or my SCB upon request being made by MA or my SCB, any
of my Information including but not limited to any information concerning any
incident or event causing or contributing to or resulting from any injury, illness or
death to me, the details of any diagnosis and prognosis provided to me by my
Carers (or any party with the knowledge of any of my Carers), and any other
matter to the knowledge of my Carers that might reasonably be considered to
be requested by MA or my SCB for the purpose of improving safety at MA and
SCB events.
12. POLICIES AND REGULATIONS
I acknowledge, understand and agree that it is a condition of my
participation in the Event that I agree to be bound by, and subject to, the
rules, regulations and jurisdiction of MA as amended from time to time.
Copies of all MA rules, policies and regulations are available by
contacting the MA office.
13. All participants are bound by the MA anti doping policy and thus
understand they may be subject to drug testing. Testing conducted by
the Australian Sports Anti-Doping Authority (ASADA) is in accordance
with the ASADA Act and the National Ant-Doping Scheme. This involves
the taking of a sample (any human biological fluid or tissue whether alive
or otherwise, or any human breath) for the purpose of detecting the use
of a Prohibited Drug or Doping Method. Any participant infringing MA’s
policy or refusing a drug test may be disqualified or otherwise dealt with
in accordance with the terms of the anti-doping policy.
13. RIGHT TO USE IMAGE
Right to Use Image: I acknowledge and consent to photographs and
electronic images (including, but not limited to, moving images) being
taken of me during my participation in the Event. I acknowledge and
agree that such photographs and electronic images are owned by
Condobolin Auto Sports Promotions and it may use the photographs and
electronic images for promotional or other purposes without my further
consent being necessary. Further, I consent to Condobolin Auto Sports
Promotions using my name, image, likeness and also my performance in
the Event, at any time, by any form of media, to promote Condobolin Auto
Sports Promotions or the Event.
