Technical Bid Criteria
Reputed contractors who successfully executed similar works may apply on or before
17.03.2015 their tender can only be opened.
1. Basic criteria for pre-qualification of contractors/Firms:
a. Intending contractors/firms should have minimum 7 years experience
in the construction field.
b. Intending contractors/firms should have successfully completed one
similar type of works in for Government/PSUs/ CPWD/PWD (State),
reputed corporate etc. during last seven years.
c. Intending contractors/firms should have successfully completed similar
type of works as under as on 31.03.2014 for Government/PSUs/
CPWD/PWD (State)/ reputed corporate etc. during last seven years. :
i. Three similar works each costing not less than 50 Lakhs.
ii. Two similar works each costing not less than 75 Lakhs.
iii. One similar works costing not less than Rs 1 Crore .
Similar work means Supply, Installation, Testing, Commissioning and Trail run of Audio
Visual system.
d. Intending contractors/firms should be financially capable and should
submit solvency certificate for an amount of Rs. 1 Crore from any
Nationalized Bank.
e. Annual turnover of the tenderer during last three financial years( 20112012, 2012-2013 and 2013-2014) should be at least Rs.2 crore in one of the
year or the total turnover in last 3 financial years as mentioned should be
minimum 4 cores. (Rupees Four crore only).
f. Intending contractors/firms must have sufficient experienced personnel,
technical knowhow, establishment, plant/equipment to complete the
project well in time.
2. The interested Contractors/firms may apply in the prescribed format
The eligible Contractors/firms may obtain prescribed format from

The prescribed format duly filled in with all necessary particulars as stated in the
prescribed format along with attested copies of certificates/credentials regarding
jobs undertaken at various organizations should be submitted in a sealed cover
super scribing

following address on or before 17.03.2015 at- 2.30PM The Vice Chancellor,

3. Selection will be made based on particulars and documents furnished by the
applicant as required and satisfactory verification carried out by the PMC /
NLUO. Incomplete information in the application will lead to summary rejection.
If any information furnished by the applicant is found incorrect at a later stage,
they shall be liable to be debarred from tendering/taking up the work. NLUO
reserves the right to verify the particulars furnished by the applicant
independently.
4. Issue of tender documents to the Contractors/firms will be restricted to those
considered eligible from the applicant and no further press notice in this regard
will be issued. NLUO reserves the right to accept or reject any or all applications
without assigning any reasons whatsoever.
5. For any other clarifications, intending agencies may contact at the Registrar above
mentioned address before the last date of submission during working hours as
mentioned above.
6. Incomplete applications and applications not filled properly with requisite details
are liable for rejection and NLUO will not entertain any further communication in
such cases.
7. The NLUO reserves the right to accept or reject any or all applications without
assigning any reasons whatsoever.
8. Pre-bid meeting with all contractors shall be held at National Law University
Odisha. Naraj, Cuttack - 753015, ODISHA. wherein contractors can clarify any
doubts /discrepancies in documents drawings , and indicate only missing or any
item taken extra in the description of item, drawings or any details conveying
different meaning at different places, other missing details or any missing item in
Drawings/ Specifications / Conditions. All queries needs to be put up in writing
to the “ The Registrar, NLUO, Cuttack within 5 days from the date of issue of
this document. No further clarifications shall be given by NLUO and contractor
shall not claim any extra payment in future. Also contractor shall not be entitled
for any claim on such issues at later date.
All the queries should be brought out during the Pre-bid meeting only in writing.
All the queries shall deliberated and corrective action if any shall be taken during
the Pre- Bid meeting .
9. No interest shall be paid on Earnest Money Deposit and Retention money or any
other securities.

11. Amendment of Bidding Documents:

TERMS & CONDITIONS:
1. .The tender documents can be purchased from the office of the National Law University Odisha,
Cuttack, Kathajodi Campus, Sec – 13, C.D.A., Cuttack - 753015 by payment of Rs 5250.00 in the
form of Demand Draft drawn in favor of “The Registrar, National Law University Odisha”
payable at Cuttack. Tender documents can also be down loaded from the web site of the,
www.nluo.ac.in. The Agencies who down load the Tender Documents from our web site for
submissions of their tenders shall have to deposit the Cost of the Tender Documents, Rs.5250.00
in the form of Demand Draft in the envelope containing Earnest Money. 2.
The tender documents shall be submitted in three sealed envelopes on or before the due date
of receiving the tenders in the Tender box as follows:
i)
Envelope - 1 shall contain Earnest Money (and cost of Tender Documents if down
loaded from our web site).
ii)
Envelope - 2 shall contain Post Qualification Documents such as proof of eligibility i.e.
Enlistment, Annual Financial Turnover and Completion Certificates of similar works
and Annex-A

Envelope - 3 shall contain Financial Bid on the prescribed Tender form duly signed by
contractor on each page.
All the above three envelopes shall be placed in an envelope properly sealed and

The validity of tenders shall be 60 days after opening of financial bids.
10. All disputes concerning in any way with these tenders are subject to Cuttack jurisdiction
only.
11. The NLUO reserves the right to reject any or/all tenders without assigning any reason.
12. The bidder should furnish the certificate that the firm or its partners have not been
blacklisted/ debarred in the last 7 years by any of the central/ state Govt./ Central
Autonomous body/ Central Public Sector department/ Authority.

SPECIAL CONDITIONS OF CONTRACT TENDER DOCUMENT FOR SUPPLY, INSTALLATION, TESTING & COMMISSIONING OF AUDIO VISUAL SYSTEM 1.1
Tender Document This tender document, comprising of Notice Inviting Tender, Special Conditions of Contract, Technical Specifications, Schedule of Quantities and tender drawings shall form part of the contract Agreement after award of contract. Work under this contract shall be executed at contract rates as per conditions and specifications stipulated in this tender document except in respect of deviations specifically agreed to before the award of the contract and incorporated in the contract Agreement. In addition, components/materials, which may not be specifically stipulated in the tender document, but which are necessary for satisfactory installation and/or operation of any portion of the work, shall also be provided within the contract rates without any extra cost. Contractor shall carry out and complete the work in all respects to the satisfaction of NLUO as per the contract Agreement and as directed by NLUO /PMCs and as required. 1.2
Tender Conditions, Specifications and Schedule •
Special Conditions of Contract (SCC) shall be read in conjunction with Technical Specifications, Schedule of Quantities, Tender Drawings and any other document forming part of this contract Agreement including site visit. •
For any discrepancy between Technical Specifications and Schedule of Quantities, provision of Schedule of Quantities shall prevail. •
Any item shown in Schedule of Quantities and not called for in the Specifications or vice versa shall be provided as if called for in both. •
Wherever it is mentioned that the Contractor shall perform certain work or provide certain facilities, it is understood that the Contractor shall do so at his own cost. •
Where the Technical Specifications stipulate requirements in addition to those contained in the applicable Indian Standard Specifications/Codes, these additional requirements shall also be satisfied. 1.3
Departures No deviation/departure from tender conditions shall be acceptable. 1.4
Authorities The work shall conform to all the provisions of the relevant Government Legislation, Regulations and Bye‐laws of the Central/Local Authorities and of the concerned Electricity Supply Authority. The Contractor shall also be responsible for giving all notices required under the said Acts/Regulations/Bye‐laws. 8

INTENT OF SPECIFICATIONS It is not the intent of Technical Specifications to completely specify all aspects of design/construction features of equipments and all details of work to be carried out Nevertheless the intent of the Technical Specification is to ensure that the equipments and the work shall fully comply with and conform to the relevant Bureau of Indian Standard Specifications, Codes of Practice, Indian Electricity Act, Indian Electricity Rules and other Statutory Regulations, and other standards as may be applicable and to the best available standards of engineering, design and workmanship. The equipment and work shall perform in manner acceptable to Owners who shall interpret meaning of the applicable Specifications/Codes and shall have the right to reject any equipment or work, which, in their assessment, is not complete to meet the Standard/Code. 3.

SITE OF WORK Brief description of site Works covered in this contract is required for Installation and commission of Audio Visual System for moot court at NATIONAL LAW UNIVERSITY ODISHA, CUTTACK as referred to above, Tenderers are advised to visit the site after taking prior permission from NLUO for familiarizing themselves with working conditions available at site as also with the statutory levies and their prevailing quantum payable at site. Contractors shall not be entitled to claim any extra payment on account of lack of such knowledge after award of contract. SCOPE OF CONTRACT Contractor’s scope of the contract shall comprise of providing equipments, components, materials, labour, supervisory staff with infrastructure, T&P, scaffolding, consumables, testing equipment, etc. required for completion of the work as per the contract Agreement and Free Comprehensive Maintenance for one year after completion. Contract Rates shall be deemed to be inclusive of all direct and indirect expenses required to be incurred as per this scope including but not restricted to the costs of the following. The Audio Visual System shall be under the warranty of a minimum of 12 months from the date of handing over during which all the regular servicing are to be done with free of cost. NLUO will not make any extra payment. Being a techno – economical project, besides the capital cost of the equipment the Annual Maintenance Charges for 3 Years (After 1 year D.L.P), financial implications on the capital cost & AMC. The tenders shall necessary furnish the AMC charges in the Price Bid for 3 Years after warranty period and terms of AMC shall be furnished in the Technical and commercial bid clearly indicating the details regarding the scope of AMC, details of spares, consumables and equipments covered and also details of exclusions under AMC shall be furnished. Other than details furnished under exclusions all other related expenditure towards trouble free maintenance and its normal functioning shall be considered as Part of AMC. 5.1 Items of Work Design, manufacture, supply, installation, testing and commissioning of Audio Visual System as per Schedule of Quantities. 5.2 •

Statutory Levies Statutory levies as applicable as below. Which are included in the overall cost to be quoted. Central Sales tax without issue of C‐form by NLUO. Excise duty/custom duty. Work contract tax Octroi Any other levies. Service Tax. Testing Testing for the various items of equipment shall be performed at the contractor’s cost and test certificate to be furnished by the contractor. If required by the PMC/NLUO, the Contractor shall permit the NLUO authorized representative to be present during any of the tests. After notification to the Owner that the installation has been completed the contractor shall make under the direction and in the presence of the PMC such test and inspections as have been specified or as the PMC shall consider necessary to determine whether or not the full intent of the requirements of the plans and specifications have been fulfilled. In case the work does not meet the full intent of the specifications and further tests shall be considered necessary the contractor shall bear all the expenses thereof. Transportation, Storage, insurance etc. Loading, transportation and unloading. Protection of stored materials/installed work against damage due to dirt, sun and rain including providing tarpaulin/ PVC sheet covers as required. Providing security arrangements/watch and ward for stored materials and installed works to guard against pilferage/damage. 5.6 Civil works, cleaning and painting 5.6.1 Civil Works •

Minor civil work items required for the work like making chases in walls/ceilings, making holes and openings, providing inserts, grouting etc including making good and painting the civil works. Housekeeping Housekeeping and clearing of work area during the tenure of contract. Final Painting Providing final paint coat to all exposed wall and providing matching paint in approved manner before handing over. 5.6.4 Site Clearance Demobilization and clearing of all temporary works/ facilities after completion of work at site and cleaning work are before handing over. 5.7 Manuals, drawings etc. 5.7.1 Along with the tender Technical Parameters enclosed as Annexure‐I duly filled in by the Tenderer along with technical catalogue etc. of the equipment offered. 5.7.2 Shop drawings on award of work before commencement The Contractor shall submit GA drawings of Audio Visual System to PMC/NLUO for approval before commencement of work at site. 5.7.3 Operation and maintenance manuals Three sets of operation and maintenance manual with support drawings shall be submitted to the NLUO after completion of work. 5.7.4 On site Training Training of NLUO personnel in operation, handling and maintenance of Audio Visual equipment. 5.7.5 Uptime Guarantee During Free Maintenance Period The Contractor shall provide Free Comprehensive Maintenance service for a period on one year from the date of handing over of the Audio Visual System to the NLUO. Shall include routine and preventive maintenance as and when required. Maintenance services shall be provided with 24 hour emergency call out service. Technicians shall attend each difficulties as reported and carry out immediate remedial work according to the nature of the problem. Any faulty equipment or components shall be quickly replaced. In circumstance such that the Contractor fails to attend the complain within four normal working hours after notification of the complain and where remedial work is interrupted during normal working hours for purposes other than obtaining replacement parts, the NLUO reserves the right to order such action as may be necessary to expedite completion of remedial work which shall be at the Contractors expense without abrogation of the Contractors responsibilities 11
Inspection of Work NLUO/PMC, the PMC and any person authorized by them shall at all times have access to the Works. 5.7.7 Guarantees, Maintenance & Defects Maintenance The Contractor shall maintain the Works against defects for a period of 12 months reckoned from the date of Virtual Completion of the Works, termed as Defect Liability Period or Guarantee; and in the event of more than one certificate of completion, from the respective dates so certified by the PMCs. Defects a.
The Contractor shall make good, at their own cost, and to the satisfaction of the NLUO/ PMC, all defects or other faults, arising in the opinion of the NLUO/PMC from work or materials not being in accordance with the Drawings or Specifications or Schedule of Quantities or the instructions of PMC, which may appear within 12 months after completion of work. b.
Any defects and other faults shall, upon directions in writing of NLUO and within one week, be amended and made good by the Contractor at their own cost, and in case of default, NLUO may employ and pay other persons to amend and make good such defects and faults and all costs, damages, loss and expenses consequent thereon or incidental thereto shall be made good and borne by the Contractor and such cost, damage, loss or expense shall be recoverable from the Contractor by NLUO or may be deducted by NLUO upon the PMC’s Certificate in writing from any amount due to the Contractor, and in the event of the retention amount being insufficient to recover the balance from the Contractor, together with any expenses owner may have incurred in connection therewith. c.
The Contractor may not maintain staff and labour at Site throughout the defects liability period. However, if any major defects are noted requiring their urgent attention, he shall attend to the same immediately. Rectification of Defects/ Repairs a.
Should the NLUO / PMC consider, at any time during the Supply and installation to the expiration of the Guarantee/Defects Liability Period, that any work has been executed with unsound or imperfect materials or unskilled workmanship or is of an inferior quality or not otherwise in accordance with the Contract, in respect of which the decision of the NLUO/PMC shall be final, the Contractor shall, on demand in writing from the NLUO specifying the fault; not withstanding that the same may have been inadvertently passed, certified and paid for, rectify forth or remove and repair the defective work so specified, in whole or in part, as the case may require, at their own expense: and in the event of their failing to do so within the period specified by the PMC in their demand/direction, owner. may carry out the work by other means at the risk and expense, in all respects, of the Contractor. 5.7.6

Guarantee: a.
Besides guarantees required elsewhere, the Contractor shall guarantee the work in general for 12 months from the date of completion as noted in the General Conditions. b.
All required guarantees shall be submitted to NLUO by the Contractor when requesting Certification of accounts for payment by owner c.
All required guarantees shall be submitted to NLUO in the format given as a pre‐
requisite to acceptance and payment. 6. 6.1 •

COMPLETION TIME & TIME DELAY PENALTY Completion Time The entire work shall be completed within 4 weeks from the day of issue of letter of intent. The Contractor shall submit a bar chart along with the tender and a detailed time schedule of completing salient activities of the contract to achieve overall completion for approval of PMC/NLUO. The Contractor shall ensure supply ,Installation and commissioning within 4 weeks of issue of letter of intent. If the completion of work is delayed beyond the period stipulated in the original contract agreement due to reasons considered by NLUO to be beyond the control of Contractor, extension of time for the completion of the work shall be granted by the NLUO without the levy of the time delay penalty. The extension of time shall however not entitle the Contractor to claim any extra payment and/or compensation on this account. Completion of work shall include supply, installation, testing, commissioning, obtaining the required statutory approvals if any. The work shall not be demand to be completed till all these items are completed by the Contractor to the satisfaction of the NLUO. Time delay penalty Delay in final completion. If the completion of the work is delayed beyond the completion period (as defined in para 6.1 above) stipulated in the contract agreement due to reasons considered by NLUO to be within the Contractor’s control Owners reserve the right to impose Time Delay Penalty on the contractor @ 0.5% of the total contract value per week of delay subject to a maximum of 5% of the total contract value. FREE MAINTENANCE PERIODS Maintenance Quoted rates shall be deemed to be inclusive of, free comprehensive maintenance (including spares) of Audio Visual Systems for a period of One year from the accepted date of completion of the contract. 8. a)

TERMS OF PAYMENT 20% of Contract value as an advance along with the order against submission of equivalent amount of Bank Guarantee from the Nationalized/Scheduled Bank on Owner approved format. 50% of Contract value upon delivery of materials at site. Bank Guarantee will be released after receipt of complete materials at site. 20% of Contract value after erection/physical completion of Audio Visual System Installation. Balance 10% of Contract value along on commissioning and handing over of the Audio Visual Systems subject to the following : ‐ Bank Guarantee equivalent to 5% of Contract value from a Nationalized/Scheduled Bank on NLUO approved format shall be submitted at this stage which shall remain valid for a warranty period of one year from the date of handing over. EMD will be released on submission of Bank Guarantee. The above are only stages of payment & payments shall be released only after necessary submission/checking of bills and certification by PMC/NLUO Income tax & sales tax shall be deducted from Contractors bills as per the rules prevailing during the currency of the contract. 14

PERFORMANCE GUARANTEE Immediately after the award of work the contractor shall submit a performance guarantee equivalent to 5%of contract value from a Nationalized/Scheduled bank on our approved proforma. The performance guarantee shall be effective from the date of commencement of the work until the date of commissioning & handing over. TAXES/DUTIES All sales tax/excise duty, service tax or any other taxes or levies including sales tax on works contract payable to any authorities whatsoever shall be borne by Contractors and Employer/PMCs accept no responsibility or liability whatsoever on any account. TAX DEDUCTION AT SOURCE Income tax and sales tax shall be deducted from your running account bills as per statutory requirements. FINAL BILL The payment of final bill duly certified by the PMC/NLUO shall be made within 1 months of receipt of bill after effecting due, recoveries and deductions. WATER AND ELECTRICITY Water electricity shall be supplied by NLUO at the contractors cost at one point only. Any further distribution as required shall be the responsibility of the Contractor at his own cost. The supplies shall be limited to the time and quantum supply by NLUO. GODOWN/WORKER ACCOMMODATION The accommodation for workers shall be arranged by the Contractor. No labour hutments shall be allowed within the site premises. Storage space shall be arranged by the NLUO. Contractor shall construct the stores at his cost and he shall be responsible for watch and ward of his materials/installations. 15
15. MINOR CIVIL WORKS Minor Civil works such as cutting holes and making good for call buttons, indicators including laying of sill in position and providing dash fasteners for fixing Car and counter weight, rail brackets shall be borne by the Contractors at his own cost. All scaffolding work required for erection/installation of Audio Visual Systems in the pit and the hoistway shall be arranged by the Contractor at his own cost. All structural work including plates, bolts, rag bolts, nuts, channels, angles, beams, shall also be arranged by the Contractor at his own cost. 16. 17. CONTRACT PRICE Rates should be firm and fixed for entire contract period as well as extended period for completion of work. Any of the items may be deleted as per directions of NLUO/PMC. In respect of any additional item ordered to be executed, the rates payable shall be derived from market rates, supporting vouchers plus 10% will be added there on for Contractors profit and overhead TENDER ACCEPTANCE The NLUO reserves the right to award the contract to technically & financially successful bidder. 18. 16
