Welcome to InSight™
—the program for visual processing and memory
from Posit Science. By speeding up and sharpening
the visual system of the brain, InSight can help people
think faster, focus better, and remember more.
In this guide, you’ll find a description of the InSight program,
its benefits, and its scientific approach. You’ll also find detailed

Installation, Registration,
and Sign In Instructions
Before you can use InSight, you
need to install the program,
register your account, and sign in.
Instructions for each of these steps
are below.
Please note: To install and
register, you must have a
valid email address and be
connected to the internet.
If you receive a message that
you are not connected to the
internet, you may need to
adjust your firewall or system
security settings to allow the
connection.
Installation
1. Close all programs running on
your computer.
2. Locate the program file you
downloaded.
The file name will start with
“Posit_Science_InSight_Windows”.
Double-click the file to launch the
installer. The installer will begin
loading. Please wait until it finishes.
You can track its progress in the
pop-up that appears on the screen.
3. Next you will see the Installer
Welcome screen. Click Next and
follow the directions on the screen
until you get to the Product
Registration screen.

4. On the Product Registration
screen, enter your 15-digit
registration code located in your
confirmation email. Then click
Next to continue to the License
Agreement screen.
5. Click I Accept to agree to the
license agreement. (Please note:
Clicking I Decline prevents the
software from installing.)
6. Next, the Choose Install
Folder screen will appear.
Click Install to install to
the default location:
C:\Program Files\Posit Science.
If you’d like to install to another
location, click Browse to
navigate to your preferred
location, then click Install.
Clicking Install begins
the installation process.
This process takes several
minutes.
As the installation occurs,
you will see a screen
indicating progress.

7. On the Multimedia Installer
screen, click Next to install
the Adobe Flash plug-in on
your computer. When this is
complete, click Next to finish
the installation process.

screen, click Done to register
and sign-in.
Please note: If you
would like to register
your program later,
select Run InSight
later and click Done.
When you’re ready to
begin training, double-click the Posit
Science InSight icon on your desktop to
start the registration process. You will
be asked to enter your registration
code and accept the license agreement.
Click Accept to continue.

Learn About Brain Health
Once InSight is installed, the “Learn
About Brain Health” icon will appear on
your desktop (along with the program
icon). Clicking this icon
will take you to a helpful
website where you can
learn more about the
brain and brain fitness.

Registration and Sign In
Before you can begin using
InSight, you will need to register.
Follow these steps to do so.

installation process, the following
screen appears. Click Set up
account to begin the registration
process. If you are asked to enter
your registration code, please do
so and click Next.

Information screen. Fill in your
personal information and
click Next.

you to choose your username,
password and to enter your email
address. When you have finished,
click Finish Registration.

A few notes about your account:
• You may select any user name you
like, provided it is at least 6 letters and/
or numbers long. (No other characters
are allowed.) If the user name you
choose is already in use, you will be
prompted to choose a different one.
You will see your user name each time
you use the program.
• Choose any password you like,
provided it is at least 6 letters and/or
numbers long. (No other characters
are allowed.)
• You must use a legitimate email
account. If you ever forget your
password, you will need to enter your
email address in order to reset it. We
suggest that you store your user name
and password information in a safe place
for future reference.
4. You will then see the
Registration complete screen.
Click Sign in to continue. If
prompted to accept the license
agreement, click I Accept. Note:
The program will remember your
password unless you uncheck the
“Remember Password” box.

you are almost there!
The next screen you’ll see will
be your Homepage. Here, you
can also access your My Account
webpage, Support website, and
start training!
Adding a Second User
To add a second user to the same
computer, you will need to have
purchased the 2-user version of InSight.
Launch the program and click the Sign
in button that appears below the user
name(s) you have previously created.
Next, click Set up account and follow
the registration instructions to add the
second user.
Training on Multiple Computers
You will need to download and install
Insight on each computer you wish to
use for your training. However, you will
only need to register once. You can
access your download link and registration code in your original order
confirmation email or via the My Account
website. To access My Account, go to
https://cortex.positsci.com/myaccount/
and enter your InSight user name and
password. After you have installed the
program and signed in using your
existing user name and password,
please accept the license agreement and
proceed. Note: You will need to be
online to do this.

Forgot User Name or Password?
Should you ever forget your user name or password, click the
Sign in button below your user name on the Sign in screen. On
the next screen, click Forgot username or password? on the
right hand side. You will be prompted to enter your email address
so Posit Science can send your sign in information.
Please note: If you do not receive an email, you may need to check your
“junk” or “spam” email folder.
Thank you for installing InSight!
Uninstalling
Should you ever want to uninstall InSight, follow these steps:
1. Click the Windows Start menu and select All Programs
2. Choose the Posit Science program folder
3. Click on the Uninstall InSight icon. The Uninstall InSight Wizard
will appear. Click the Uninstall button to continue.
4. Wait while the Posit Science InSight files are removed
5. When completed, click the Close button.
If you have a previous version of InSight installed on your computer,
you have to uninstall it before installing InSight V1.2.
Note that uninstalling will not remove your user data. If you uninstall
and then re-install a new version of Posit Science InSight, your
account and progress information will be carried over to the new
version.

InSight:
A Program for Visual Processing & Memory
You may be wondering how a visual program helps to improve
overall brain fitness. Our senses are incredibly important to
cognitive function, including memory. After all, what is a memory
but a collection of things we sensed—what we saw, heard, felt,
tasted, and smelled—at a particular time? Vision is one of the
most important senses in telling our brains about what is going on
in the world around us. Unfortunately, beginning around age 30,
our visual processing gradually weakens. The brain doesn’t take
in visual information as quickly as it did, and its ability to manage
multiple visual events at the same time declines. Your brain can’t
react to a child stepping off the curb into the street or a cat darting out between cars while you’re driving as quickly as it once
did. When visual processing weakens, it affects all the cognitive
functions that rely on the senses for information. The result is that
people often don’t feel quite as

sharp as they’d like to feel.
Over the past twenty years, scientific

is nearly unanimous in accepting that
the brain is “plastic”—that it can

of the brain’s many complex systems

by encouraging faster, clearer

neurons (brain cells), and training the brain to take in more

About InSight

This is a different
approach from many
other brain fitness programs, which simply drill
your memory or teach
you tricks for better
memory, focus, and
thinking. Our approach is
more like the one a good
gardener takes: We don’t
just tend the flowers and
leaves (memory tasks).
We understand that no
matter how much you
care for the flowers and leaves, the plant won’t be healthy unless
its roots (sensory perception) are also in good shape. The roots
must be able to take in and deliver crucial nutrients (information)
to the rest of the plant in order for it to thrive. InSight exercises a
key set of those roots.
Clinically Proven Benefits
InSight exercises incorporate Useful Field
of View (UFOV®)—a visual training method
described in numerous published studies,
many funded by the National Institutes of
Health. These studies demonstrate that
people who use this training technology
experience multiple benefits, including:
• A 300% increase in visual processing speed
• A 200% increase in useful field of view
which allows you to notice more in your
peripheral vision
• A 50% reduction in crash risk
• Ability to stop 22 feet sooner when driving
at 55mph
Studies also show that people who train with the technology
included in the InSight exercises are more likely to keep their drivers’ licenses later in life, leading to extended independence and
higher quality of life.
Program Summary
In InSight, you’ll be playing five computer-based exercises that
sharpen your brain at its core to take in more information and
react faster to what you see.
Before beginning each exercise, you’ll take an assessment to set
your individual baseline level for the cognitive skill the exercise
targets. The assessment will use this baseline to set an improvement goal for you. As you work in the exercises, you’ll take follow18

up assessments to measure your improvement.
The exercises are built on a special algorithm that allows them
to continually adapt to your individual level. As you get better at
the exercise, it gets a little harder in order to push your brain to
improve more! If you have an off day, the program will back off a
little.
We recommend you use InSight 3 to 5 times a week for 40
minutes at a time. It will likely take approximately 40–50 hours in
total to complete the Recommended Schedule (about 8–10 hours
per exercise), though you should experience benefits well before
that. Studies show that after 10 hours of training, you will experience significant results. We encourage you to continue to work
in InSight for an unlimited time. Since the exercises adapt to you,
they never stop being an effective brain workout.
Beginning Your InSight Journey
After installing and registering InSight (see pages: 3–9 for PC,
10–16 for Mac), you can begin your first InSight session. Here’s
what you’ll see during your first and subsequent sessions:
Homepage: After you launch
InSight and select your InSight
user name, you’ll enter the
Homepage. There, you’ll see
messages about the program
and have the opportunity to
view your My Account page—
which contains progress and
performance data—and connect to our support community. Click the Start button in the lower right-hand corner of the
screen to begin training.

Video Check: On the first day,
you’ll see a Video Check after
the Homepage. This page verifies that your computer’s video
card works with the program.
Video Check: the image may appear
blurry but if you can see it, your
computer can run InSight.
Introductory video: After the
Video Check, you’ll see a short
video about the program and
its exercises. This video plays
automatically your first time
in InSight. To watch the video
again in the future, click View
the science behind InSight
from the Main Menu.
Viewing Distance screen:
On your first session, you’ll see
the Viewing Distance screen
after the Introductory Video.
The Viewing Distance screen
gives a recommendation for
how far to sit from your monitor for the best brain workout.
Since this is a visual training
program, viewing distance is
important. You can review the
screen during later sessions by
clicking Viewing Distance from
the Main Menu.
You can also reach your
performance summary and the introductory video from the Main Menu.

Main Menu: Your training session begins on the Main Menu and
it is where you determine your schedule for the day.
Choosing a schedule:
When to select “Begin Today’s Recommended Schedule”
We encourage you to use the Recommended Schedule. The
Recommended Schedule was designed by our science team to
give your brain a thorough workout in each session. Each InSight
Recommended Schedule session lasts for about 40 minutes. In
your first sessions, you’ll take brief tutorials to learn how to use
the exercises. You’ll also take exercise assessments to set your
baseline and goal in the cognitive skill the exercise targets (see
below for more information on assessments). After that, the
Recommended Schedule will consist of 10 minutes of training
in each of the scheduled exercises for that day.
When to select “Choose Exercises Myself”
Do you have more—or less—than 40 minutes available? Are you
in the mood to do one exercise but not the others? If so, select
Choose Exercises Myself. That option allows you to choose an
exercise and train in it for as long as you like.
Whether you follow the Recommended Schedule or choose exercises yourself, you can always end an exercise by clicking Pause or
End this exercise.
Assessments: After you choose your schedule, you’ll begin your
training. The first time you go to an exercise, you will take the
exercise assessment to set your baseline level in the cognitive skill.
The assessment is similar to the exercise, but slimmed down to
focus on the scientific tasks (rather than the game-like elements).
Note that the assessments are very difficult by design. Don’t feel
badly if you find yourself giving many incorrect answers. Everyone
does! The assessments must determine the exact point at which
you can—and cannot—respond accurately.

You can take an assessment at any time by clicking View my
performance summary from the Main Menu and then selecting
the exercise for which you’d like to take the assessment.
Exercises: After taking your first assessment in each exercise, you
will begin training in the exercises themselves!
The InSight Exercises
Five training exercises form the core of the InSight program.
Each of the exercises works your brain in a different way. They are
designed to build on one another to speed up and sharpen the
brain on many levels.
Exercise 1: Bird Safari
Bird Safari works on your visual precision, which
helps the brain perceive things quickly and accurately so that it
can recall them better. Visual precision is what enables you to
remember details about what you saw in a movie, at a party, at
a store, when house hunting, and everywhere else you go. If you
remember such details accurately, you can talk about them later
and take action.
THE SCIENCE:
Bird Safari exercises your visual precision by asking you to locate
specific birds in your peripheral vision, even when they appear on
screen for a very short time. At first, the birds are fairly distinct,
appear close together, and are presented on a simple background.
Over time, these things change in several ways:
• The bird pairs become more similar, challenging the brain to
make finer distinctions.
• The birds spread farther apart, pushing your brain to see details
farther from the center of visual attention and expand its useful
field of view.

bird photographer traveling to different areas to take photos of
local birds. In each of three places—Tampa, Florida; San Francisco,

California; and Playa Blanca, Costa Rica—you take three snapshots
of nine birds. In order to take the snapshots, you must repeatedly
spot the right bird in the midst of a group of similar birds—even
when you only have a second or two to make your choice! Each
time you take a snapshot, you’ll add a new photo to your collection and learn a little about the bird. When you take all three snapshots of a bird, the bird will be “filled in” on the map of the area

Exercise 2: Jewel Diver
Jewel Diver is designed to help build divided attention by requiring you to track several items moving around the
screen at the same time. A strong ability to divide your visual
attention has many benefits—both for driving, playing sports, and
in other aspects of life. For example, it’s what allows you to simultaneously track several moving cars and pedestrians when driving
through a busy intersection.

In Jewel Diver, you will see jewels and bubbles appear on the
screen. The jewels are then covered by bubbles and you have
to keep track of which bubbles cover the jewels as they move
around the screen. When the bubbles stop moving, you click on
each one that hides a jewel.
As you move through the exercise, it gets harder: the jewels travel
more quickly, for longer amounts of time, and over larger areas.
In addition, the exercise adapts to your performance by changing the number of jewels to track. It adds to the number if you’re
repeatedly successful, and subtracts from the number if you’re
struggling.
In Jewel Diver, you are a deep-sea explorer
searching for sunken treasure in the Marianas Trench, the Sargasso Sea, and the Barrier Reef. To finish exploring an area, you
must move through the entire “map.” Each time you take a step
forward on the map, you will see a progress map with a new buoy
or window lit up. When you see the map, you should feel good
about how you’re doing. It means you’ve made it to the next level
in the exercise!

Exercise 3: Master Gardener
Master Gardener exercises your visual working
memory—your ability to hold what you see in mind long enough
to react to it or transfer it to long-term memory. Working memory
is very brief, lasting less than a minute in most people, but it’s very
important to overall sharpness. It’s what enables you to remember who is who in a new setting, the order of events at a meeting,
and much more. The longer and more precise your visual working memory is, the more successful you will be at recording—and
therefore recalling—a wide variety of memories.
THE SCIENCE:
Master Gardener works out your working memory by asking you
to match pictures shown sequentially on screen. For example,
it might show three butterflies, one after the other, and require
that you click the two that matched. The exercise challenges your
brain to improve by:
• Adding to the number of pictures you see
• Spreading the pictures farther apart to expand your useful field
of view
• Making the pictures more similar, so that you have to remember
more subtle details
• Decreasing the contrast between the pictures and the
background

Exercise 4: Road Tour
Road Tour extends your useful field of view—the area
over which you can quickly and accurately see details when looking straight ahead. Expanding useful field of view helps the brain
gather more information from the environment. This comes in
handy when quick detection and reaction can make the difference,
such as when a deer comes running into the road in front of you.
THE SCIENCE:
Road Tour gets you to work at the edges of your useful field of
view so that it gradually expands outwards. It also encourages
the brain to extract information from your useful field of view
more quickly. It does so by focusing your attention on a task in
the middle of the screen: you have to choose which of two cars
you saw after one appears briefly in the middle of the screen. But
at the same time, you have to notice where a Route 66 road sign
appears in the periphery of the
screen. The task gets harder in
several ways:

• At first, the road sign is alone
in the periphery, but over time,
distractors (wrong answers)
appear too.
• The road sign moves from closer to the center to farther out.
• The central cars get more similar, making it more difficult to
choose the right one.

you’re doing well, they speed up!
As you move through the exercise, these features challenge your
brain to improve the speed, size, and reliability of your useful field
of view.

can ignore them. Points are not
related to your performance in the
science task. If they don’t motivate
you, don’t pay attention to them!
To move your white car around
the circle—and get to new
places on the route—you have
to line up three or more cars of
the same color—yellow, red,
or green. When you do so, the
cars collapse, and your white
car moves forward. The more cars you line up, the more points
you get. When your white car travels four times around the circle,
you’ll arrive at a new destination on your Route 66 tour.
As with the other exercises, there are three major levels in Road
Tour: The Painted Desert, Texas, and Illinois. Have fun working

Exercise 5: Sweep Seeker
Sweep Seeker is designed to speed up visual
processing. Faster visual processing helps you take in more
information quickly and correctly, so that you can react to it
at the time and remember it better.
THE SCIENCE:
In Sweep Seeker, you watch two visual “sweeps” (movements of
bars) and determine whether each one swept inward or outward.
It may not be obvious, but when broken down to its most basic
parts, everything in our visual world is constructed entirely of
sweeps like these. The brain’s ability to effortlessly identify these
sweeps is essential to our visual acuity.
Different types of sweeps activate different sets of neurons—the
nerve cells in the brain. To activate the highest possible number
of neurons, the sweeps change in several ways:
1. There are five different colors of sweeps, carefully chosen to
maximize neural response.
2. There are four different
sweep orientations: vertical,
horizontal, and two diagonals.
The sweeps have different orientations, bar widths, and colors.

If you’re like most people, you probably want to know how you’re
doing as you work through InSight. There are two ways to chart
your progress throughout the program. These include:
1. Your progress through the exercise stimuli.
2. Your performance on the assessments.
Progress Through the Exercises
Although each exercise adapts to your individual performance,
some of the changes in the exercise are scheduled. For example,
in Bird Safari, the exercise adapts to your performance by increasing or decreasing the amount of time the birds appear on screen.
But the other changes—in the background, the bird pairs, and so
on—are scheduled. In Bird Safari, there are 81 different possible
stimuli sets.
Each time you complete a stimuli set, you’ll visit the exercise
“map” for that exercise. One
image on the map will fill in for

first time, you take its assessment to set your performance
baseline—your starting level in
the cognitive skill.

When you
first retake an assessment, you may
not reach your exercise goal—or
make much progress at all. That’s
okay. You may have to train for
several hours to achieve your performance goal. In this sense, brain
fitness is much like physical fitness—

time and effort!
Note
You will get many
answers wrong on the assessments.
They are very difficult. Their purpose
is to measure the exact level of your
skill in the science task. To do so, they
adapt to your performance, making
the stimuli harder until you can’t give
a correct answer. Only by finding
when you can’t respond correctly can
it determine the limits of your skill at
that point in your training.
The assessment begins with a
tutorial to teach you the task. Note that if you are unable to
complete the tutorial, you will not be able to train in the exercise.

appears automatically after 10 minutes. If you choose exercises
yourself, you must end the exercise manually to see the screen.

exercise screen.
2. Choose End this exercise at the bottom right.
3. Confirm by clicking Yes.

Closing an Exercise
When you work through all the material available for an exercise,
you have “closed” the exercise. You will see a screen congratulating you on your accomplishment. Reaching this point will
take between eight and ten
hours for each exercise.

an assessment. Please do so!
Only by taking the assessment
can your improvement in the
cognitive skill be measured.
After you complete an exercise, it will be removed from your
Recommended Schedule. However, you can keep training in
that exercise by using the Choose Exercises Myself option from
the Main Menu. The exercise will start from the beginning—but
that doesn’t mean your brain isn’t getting a workout. Since each
exercise adapts to your individual performance, it will continue to
challenge your brain.

The My Account Feature
The My Account feature is an online tool you can use to manage
your personal InSight account. From it, you can view and print
comprehensive reports of your progress, change information in
your profile or download the program.
To access My Account, go to
https://cortex.positsci.com/myaccount/. You will be prompted to
fill in your InSight user name and password. (You can also access
My Account directly from the Homepage screen in InSight. You
will not be prompted to enter your user name or password in that
case). Once you have done so, you’ll see three tabs:
My Reports, My Profile, My Downloads.

When you first enter your account, you’ll see your reports page.
On this page, you can view a comprehensive report of your progress in the five InSight exercises.

ANY ACCOMPANYING DOCUMENTATION (COLLECTIVELY, THE “SOFTWARE”).
THIS AGREEMENT ESTABLISHES THE TERMS AND CONDITIONS UNDER WHICH
POSIT SCIENCE CORPORATION (“POSIT SCIENCE”) WILL PERMIT YOU TO USE THE
SOFTWARE AND GOVERNS YOUR USE OF THE SOFTWARE. IF YOU INSTALL OR USE
ANY OF THE SOFTWARE, OR KEEP IT FOR 30 DAYS AFTER THE DATE YOU RECEIVE IT,

make a single copy of the Software for backup purposes, provided that you reproduce
on it all copyright and other proprietary notices that are on the original copy of the
Software. Posit Science reserves all rights not expressly granted to you in this Agreement,
including but not limited to patent, copyright, trade secret and trademark rights.
2.
Restrictions. You may not: (a) copy or modify the Software (except as
expressly specified in Section 1); (b) transfer, sublicense, encumber, lease, lend, rent or
otherwise distribute the Software to any third party; (c) make the functionality of the
Software available to anyone other than the users licensed under Section 1, through
any means, including, without, limitation, by uploading the Software to a network or
file-sharing service or through any hosting, application services provider, service bureau
or any other type of services; or (d) use the software if you are: (i) in pre-school through
twelfth grade, (ii) in a correctional institution, (iii) part of the US government, (iv) an end
user under US government contract, or (v) seeking treatment for a disease or disorder or
for dyslexia or a similar reading impairment. You acknowledge and agree that portions
of the Software, including, without limitation, the source code and the specific design
and structure of individual modules or programs, constitute or contain trade secrets of
Posit Science and its licensors. Accordingly, you agree not to disassemble, decompile
or otherwise reverse engineer the Software, in whole or in part, or permit or authorize a
third party to do so, except to the extent such activities are expressly permitted by law
notwithstanding this prohibition. You will not create or alter tables or reports relating to

related to data privacy, international communications and the transmission of technical
or personal data. You shall: (a) notify Posit Science immediately of any unauthorized
use of any password, login ID or user account (“Account Data”) or any other known or
suspected breach of security; (b) report to Posit Science immediately, and use reasonable
efforts to stop immediately, the unauthorized or illegal copying or distribution of the
Software, Account Data or Progress Reporting Data that is known or suspected by you;
and (c) not impersonate another Software user or provide false identity information to
gain access to or use the Software, Account Data or Progress Reporting Data.
4.
Ownership. The Software is licensed, not sold. You own the media on which
the Software is recorded, but Posit Science retains ownership of the Software, including
all intellectual property rights therein. The Software is protected by United States
copyright law and international treaties. You will not delete or in any manner alter the
copyright, trademark and other proprietary rights notices or markings appearing on the
Software as delivered to you.
5.
Term; Termination. The rights granted in Section 1 of this Agreement remain
effective until terminated. You may terminate such rights at any time by destroying
all copies of the Software in your possession or control. Such rights will automatically
terminate without notice if you breach any term of this Agreement. Upon termination
of such rights, you must promptly destroy all copies of the Software in your possession
or control. All other provisions and all other rights and obligations of either party will
survive the expiration or termination of this agreement for any reason.
6.
Limited Warranty. Posit Science warrants that for thirty (30) days following
the date you receive the Software, it will perform substantially in accordance with its
documentation, but not that use will achieve any particular results. As your sole and
exclusive remedy and Posit Science’s entire liability for any breach of this limited
warranty, Posit Science will at its option and expense promptly correct or replace the
Software so that it conforms to this limited warranty or, if Posit Science is unable to do
so after using its reasonable efforts, then Posit Science will accept return of the nonconforming Software and refund the amount that you paid for such Software. You understand that the Software is intended to improve visual signal reception and processing,
memory and other cognitive function; however, it is still being tested and Posit Science
does not represent that it is effective in doing so. Posit Science does not warrant that
the Software will meet your requirements, that the Software will operate in the combinations that you may select for use, that the operation of the Software will be error-free or
uninterrupted, or that all Software errors will be corrected. The warranty set forth in this
Section 6 does not apply to the extent that Posit Science provides you with the Software
(or portions of the Software) for beta, evaluation, testing or demonstration purposes.

Consent to Collection of Progress Reporting Data. Posit Science collects
certain progress reporting data and statistics generated when you use the Software
(“Progress Reporting Data”). This Progress Reporting Data may be used to help us
understand and analyze your use of the Software, provide customer support, and deliver
to you customized data reports about your progress. You acknowledge and agree to the
collection and use of the Progress Reporting Data by Posit Science and hereby assign to
Posit Science all right (including but not limited to all intellectual property rights), title,
and interest to and in, all Progress Reporting Data. Progress Reporting Data, in association with information that can identify you personally, will not be shared with anyone
outside of Posit Science without your permission. Please see our Privacy Policy located

and disclosure of information collected through the use of our Software and services.

Import Export Law. You agree to comply fully with all applicable import and
export laws and regulations to ensure that neither the Software nor any technical data
related thereto nor any direct product thereof are exported or re-exported directly or
indirectly in violation of, or used for any purposes prohibited by, such laws and regulations.

General. This Agreement will be governed by and construed in accordance with the laws of the State of California, without regard to conflicts of law rules
or principles. The United Nations Convention on Contracts for the International Sale
of Goods will not apply. You may not assign or transfer this Agreement or any rights
granted hereunder, or delegate any duties granted hereunder, by operation of law or
otherwise, and any attempt by you to do so will be void and of no effect. The exercise
by either party of any remedy will be without prejudice to its other remedies under
this Agreement or otherwise. The failure by either party to enforce any provision of
this Agreement will not constitute a waiver of future enforcement of that or any other
provision. Any waiver, modification or amendment of any provision of this Agreement
will be effective only if mutually executed in writing. If any provision of this Agreement
is held to be unenforceable or invalid, that provision will be enforced to the maximum
extent possible and the other provisions will remain in full force and effect. This
Agreement is the complete and exclusive understanding and agreement between the
parties regarding its subject matter, and supersedes all proposals, understandings or
communications between the parties, oral or written, regarding its subject matter. Any
terms or conditions contained in your purchase order or other ordering document that
are inconsistent with or in addition to the terms and conditions of this Agreement are
hereby rejected by Posit Science and will be deemed null and of no effect.
