Clearance Certificate for supply and installation of One Line Printer with on-site warranty
in the Oris sa High Court. The bidders (OEMs 1 Authorized
Distributors

Dealers) must submit their bids in two parts i.e. (i) Technical Bid and (ii) Price Bid. Both
the Technical Bid and the Price Bid should be submitted in two separate sealed covers duly
superscribed as the TECHNICAL BID (COVER' A') and the PRICE BID (COVER 'B')
and both the bids should be put into a third cover which should be superscribed

The PRICE BID (COVER "B") shall contain the following document.
The price of the item should be quoted as per Annexure-V. The net quoted price inclusive
of all taxes should be both in figures and words. Hard copy should be signed and sealed as
per Annexure-V.
EARNEST MONEY DEPOSIT (EMD)
I.
UO,OOO/- should be paid as EMD in the form of Demand Draft from a Nationalized
Bank located in India, drawn in favor of "The Registrar (Judicial), Orissa High
Court, Cuttack" payable at Cuttack and submitted along with the Technical Bid
(Cover-A).
11.
The bidder should write the organization name at the back side ofthe DD.
Ill.
Bids without EMD will be rejected.
IV.
No exemption from submission ofEMD is allowed.
V.
The EMD of successful bidder is liable to be forfeited if the tenderer revokes any
terms of the tender within the validity period.
VI.
EMDs given by unsuccessful bidders will be refunded after placing of purchase
order to the successful bidder.
VII.
EMD of the successful bidder will be forfeited in case the successful bidder fails to
accept I executes the order.
VIII. EMD of successful bidder will be returned after submission of performance security
in the form of Bank guarantee.
IX.
EMD shall not carry any interest.
PERFORMANCE SECURITY
The Successful bidder should furnish Performance Security for an amount @ 5% of the
order value, which is to be submitted at the time of delivery of the Line Printer at Orissa

High Court in the form of Bank Guarantee from a Nationalized Bank addressed to "The
Registrar (Judicial), Orissa High Court, Cuttack".
WARRANTY / SUPPORT
I.
The warranty (Comprehensive) / support shall remain valid for 3 years onsite.
11.
Any replacement or repair required within the warranty period will be provided
by the supplier free of cost. The supplier will take back the replaced parts / goods
at the time of their replacement. No claim whatsoever
shall be made on the
purchaser for the replaced parts / goods thereafter.
Ill.
No travelling allowances or transportation
cost will be paid by the purchaser
during warranty period.
IV.
The Supplier is required to give warranty that the Goods supplied under this
contract are new, unused, of the most recent or current models and they
incorporate
all recent improvements
in design and materials
(even if the
advanced facilities are not mentioned in our product specification).
V.
The Supplier shall give further warranty that all Goods supplied under this
contract shall have no defect arising from design, materials or workmanship or
from any act or omission of the Supplier that may develop under normal use of
the supplied Goods in the conditions prevailing in the place of final destination.
DELIVERY, INSPECTION & INSTALLATION
I.
The Line printer shall be delivered and installed at Orissa High Court, Cuttack by
the successful bidder within 2 weeks from the date of issue of Purchase Order.
11. After installation of the Printer, the bidder must demonstrate the working of the said
Line Printer before the competent authority.
Ill. A report should be prepared regarding fine working of the Line Printer and signed
and submitted to the Registrar (Judicial), Orissa High Court, Cuttack by the
bidder.
PAYMENT TERMS
I.
The payment will be made after successful delivery and installation of the Line
printer at Orissa High Court, Cuttack and submission of demonstration Report. No
advance payment will be made for the supply.

H. If the successful bidder fails to supply the Line printer in the specified time period,
the Purchase Order shall stand cancelled.
PENALTY FOR FAILURE TO MAINTAIN DURING THE WARRANTY PERIOD
I. The Supplier, on receipt of complaints, must attend the complaints to rectify the
defects within 12 hours during the warranty period,
II. The bidder must undertake to supply all spares in case of the item for optimal
upkeep of the equipment for 3 years at the site.
Ill. In no case the Line Printer should remain in non-working condition for more than 1
working day.
IV. In Case of failure on the part of the Supplier to attend the complains to rectify any
defect in the Line Printer within the time frame, remedial action shall be taken such
as forfeiture of the security deposit submitted by the Supplier in the form of Bank
Guarantee.
LEGAL JURIDICATION
All legal disputes are subject to the jurisdiction of Courts at Cuttack or Orissa High
Court, Cuttack.
