rental policy
Every LESSEE is entirely responsible for the equipment leased. In signing the rental contract, the LESSEE acknowledges that they have inspected the equipment specified herein and that the equipment is in good working order. Vidéographe is not responsible for misuse of the equipment by the LESSEE, the LESSEE’s incompetence, or for any damage to the equipment. The LESSEE is entirely responsible for any damage or loss resulting from negligence on the part of an operator while the equipment is in their possession. Should the equipment require repair, or should it be lost or stolen, the cost of repair or replacement will be charged to the LESSEE’s account. Vidéographe cannot be held responsible for any prejudice arising from the use of its equipment.
Rental Contract
The LESSEE recognizes that the items and equipment specified herein are the property of Vidéographe, hereafter named the LESSOR.
1. Competence: The LESSEE and those operating the equipment are required to know how to handle and operate correctly the equipment they wish to rent.
2. Training: Any LESSEE who does not possess the knowledge or experience required to use the equipment that they wish to rent must work with a competent person or undertake adequate training in advance.
3. Use: The LESSEE agrees not to remove, alter, disfigure, or cover up any numbering, lettering, or insignia displayed on the equipment, including stickers or labels indicating the LESSOR’s registration. Equipment must remain in the LESSEE’s possession for the duration of the rental period and until the equipment is returned to the LESSOR.
The LESSEE may not sub-let, loan, or give the equipment to any person or enterprise without the LESSOR’s consent. The equipment must remain in the care of the LESSEE. Furthermore, the LESSEE must have the consent of the LESSOR before transporting or using the equipment outside of Quebec. It is understood that a penalty will be incurred for late return.
The LESSEE hereby attests to having examined and verified the equipment specified and agrees that the equipment is in good working order and appearance.
4. Responsibility: Each LESSEE is entirely responsible for the equipment rented from the LESSOR in their name. The LESSEE is also responsible for any direct or indirect damage or loss that may occur during the rental period. A LESSEE who returns damaged equipment without declaring the damage that occurred while the equipment was in their possession will be responsible for the cost of repair and may lose their membership privileges.
5. Indemnity: The LESSEE discharges or exonerates the LESSOR from all responsibility for damage or loss, including loss of data or loss of revenue. Should the equipment become unsafe or fail to operate, the LESSEE must discontinue use immediately and inform the LESSOR as soon as possible. If the equipment does not function, the LESSEE will not be charged.
6. Liability: Each LESSEE is responsible for the cost of repair/replacement of equipment. Should the equipment be lost or stolen, the LESSEE must notify the LESSOR and file a police report immediately. If the loss is not covered by insurance, the LESSEE is responsible for the entire cost of replacing the equipment. If the loss is covered by insurance, the LESSEE should pay the deductible fee of $2000. Should the equipment be needed immediately for another shoot, the LESSEE will also be responsible for the rental costs of the equipment that should have been available.
7. Damage deposit: A deposit of five hundred to a thousand dollars may be required at checkout.
8. Alterations and repair: The LESSEE agrees to make no alterations, additions, nor improvements to the equipment.
9. Additional insurance: The LESSEE must provide, at their own expense, insurance coverage for full replacement costs of all equipment rented from the LESSOR with an insured value of more than $35,000.
10. Travel: Travel days shall be billed at the normal daily rental rate.
11. Using equipment abroad: Any LESSEE who wishes to use the LESSOR’s equipment outside of Canada must obtain prior consent from the LESSOR, who reserves the right to refuse, with or without giving a reason. The conditions will be negotiated on a case-by-case basis.

12. Maintenance and cleaning: Equipment and editing suites must be restored to a clean and orderly condition after each use. Any LESSEE who fails to do so will incur cleaning and maintenance costs of at least $50. The LESSOR is not responsible for the equipment’s technical settings. It is the LESSEE’s responsibility to verify the technical perimeters of the equipment prior to the shoot and to render this with the default settings. The LESSEE must erase their data from any memory cards and ensure the equipment’s batteries are fully charged as much as is feasible.
13. Checkouts and returns: The LESSEE may check equipment out between 1 p.m. and 5 p.m., Monday to Friday. The equipment must be returned between 9 a.m. and 12 p.m. Monday to Friday. LESSEES who return equipment after 12 p.m. will be charged for a full day of rental. Should the equipment be required immediately for another shoot, the LESSEE will also be charged for the rental costs of providing the necessary equipment. Should the LESSEE be unable to meet these timelines, a specific time will be agreed in advance with the LESSOR.
14. Cancellation: The LESSEE must advise the LESSOR of any cancellation of rental bookings of equipment or facilities at least 48 hours in advance. Should the LESSEE fail to advise the LESSOR within this time, they must pay the full rental fee(s).
15. Payment methods: The LESSEE must pay the rental fee(s) and deposit to the LESSOR before checkout. The following methods of payments are accepted: Visa credit cards, debit cards, and cash.
16. Accounts outstanding: The LESSEE reserves the right to recover all monies due. In addition, a LESSEE with accounts outstanding will forfeit the right to access the LESSOR’s equipment and services.
17. Access to editing suites and facilities: An individual wishing to rent the LESSOR’s editing suites or facilities outside of office hours must obtain the keys from the LESSOR. Should the keys get lost, the LESSEE must pay the cost of replacing keys and locks.
18. The LESSEE is not authorized to make copies of keys and assumes full responsibility for the use of said keys. Should the LESSEE lose the keys, they must assume the cost of replacing them.
19. Disputes: The LESSEE shall advise the LESSOR immediately of any seizure or other legal proceedings in which the equipment might be implicated. The LESSEE reserves the right to take the equipment back immediately, to enter any premises in which the equipment might be kept, and to take the equipment without notice or express permission and free of all responsibility towards the LESSEE. Under this contract, the LESSOR’s sole possible responsibility in a dispute against the LESSEE is the reimbursement of the rental fee(s). The LESSEE hereby agrees to pay the LESSOR all legal expenses incurred in upholding the LESSOR’s rights in the event of a dispute. Consent on the part of the LESSOR to hand over rented equipment does not constitute a relinquishment on the LESSOR’s part of any claim that they could make against the LESSEE under this contract for any loss or damage, apparent or otherwise, caused to the equipment.

Month rental (28 days) = Billed for ten days
