The Additional Director General of Police, Special Branch, Assam invites Sealed

Bids with affixing non-refundable Court Fee Stamps of Rs. 8.25 (Rupees eight and

Paise twenty five) only (in Part-II of the Bid) for strengthening of SB Hqrs. through implementation and maintenance of a suitable System Integrator (SI) (hereinafter referred to as ―Bidder‖) to carry out Procurement, Supply and Installation of necessary computing infrastructure with Connectivity, Training and operations support from a competent firm with experience in the automation projects involving large scale data processing and data analysis in India. The Bidder shall be finalized through a competitive bidding process based on the response to this RFP.

1. ABOUT

1.1PROJECT BACKGROUND

Title of the Project:

Automation of Special Branch, Assam Police (ASB-AP)

The project covers various aspects relating to automation of the activities of Special

Branch, Assam Police. The project would focus on enabling internal automation of

Office of the Additional Director General of Police, Special Branch with the creation of necessary state of the art IT infrastructure at SB Head Quarters, Kahilipara and the various district SB offices in Assam.

1.1.1 Project Initiator Details

1.1.2 Background of Special Branch, Assam Police

The State Special Branch did not have a separate existence till 1965, as it had been functioning under the DIG of Police, CID. In 1965 the Special Branch was bifurcated from the CID and was placed under the command, control and supervision of the

DIG of Police, SB. Eventually this position has been upgraded to that of an

Additional Director General of Police who exercises overall command, control and

Supervision of the Branch

This branch deals with the collection, collation and dissemination of intelligence having security and law and order implications. It usually deals with sensitive matters like public agitation, subversive activities which carry potential and real danger to the security of the state and the nation. Security matters of the vital

Installations and key industries also fall within its purview.

With the development and use of sophisticated technology in the electronics field, the special branch has geared itself to keep pace with these developments by upgrading itself in all spheres in the last years. It has made significant improvements in using modern techniques and in the restructuring as well as in the redeploying of its personnel to cater to the needs of effective intelligence.

The work of the Special Branch is carried out through three different set ups:

Headquarters set-up

Zonal set-ups, and

District Special Branch (DSB) setup in the districts.

CID HQ and Border Police HQ

The DSBs are administratively under the Special Branch Headquarters but

operationally under the respective Superintendent of Police of the District. It has an effective network of intelligence and has been rendering valuable service to the State.

The basic objective is to automate various activities of the sections under Additional

Director General of Police Special Branch, Assam, Special Branch, SB District police HQs and to intra-connect all the sections using secured high speed Local Area

Network and secured high speed Wide Area Network so that necessary and relevant information can be made available online to various sections.

1.1.5 Implementation Locations

The project will be implemented at Special Branch, O/o the Additional Director

General of Police Special Branch, Assam, Assam, Kahilipara, Guwahati. The 30 nos of SP offices located at the district headquarters needs to be connected with minimum 54 Mbps wireless connectivity from the NIC district office riding on

NICNET. Also the Additional Director General of Police Special Branch, Assam offices of CID HQ in Ulubari and Border Police at Rupnagar Guwahati need to be connected with 4 Mbps leased line / wireless from NIC Dispur.

The detail breakup of locations for supply, installation and commissioning of the various hardware/software are given in the TABLE (D).

1.2 PROJECT OVERVIEW

Good Governance means providing opportunities and proper delivery of goods and services to the people in a fair, just, effective, responsible and open way. 1.3 OBJECTIVES AND PROJECT SCOPE

Government of Assam has accorded very high priority to the IT sector and adopted an exclusive Information Technology (IT) Policy of Assam 2009. The vision of the

State is to usher an IT revolution to transform the economy of the State by giving impetus to all areas of development.

The Assam Police Special Branch views the below mentioned aspects as major challenges. Therefore the department needs the following aspects to be holistically attended to

Varied data formats ranging from structured and un-structured data like email, internet blogs, media reports, dossiers, internet traffic, social media sites like Facebook, Twitter, My Space etc.

Aid and reinforce inter-agency & Intra-agency co-ordination

Discover & co-relate widely dispersed, but related data points existing in various data silos and which may apparently (on prima facie basis) seem unrelated.

Filter out the false positives, to narrow down to information that is really valuable from an actionable intelligence perspective.

Create a quality and optimized IT infrastructure that shall lay the foundation for a Fusion Centre which shall help in capturing, processing, analysis, monitoring, assessment and dissemination of intelligence from various sources.

Comply to regulatory and legal frameworks of India and the State of

Assam, such that intelligence thus collected and necessary measures thus taken are in-line with the law, actionable, acceptable in the court of law and safeguard human rights.

Create a robust security and authorization mechanism so that only intended personnel will have access to information.

Automate real-time alerting of designated personnel such that critical discoveries and patterns are not missed out because of human negligence or error

The above services have direct connections/relations to Business and Citizen. For better, efficient and transparent delivery of services, e-Service delivery would be essential not only to address the above services, but other services that may come up in near future.

1.4 IMPLEMENTATION OF THE PROJECT IN THE STATE

OA project will be implemented at District HQ level, Special Branch HQ, CID HQ and Boarder Police HQ. The main objective of the project is to strengthen the functionalities of SB Assam police with up gradation of the existing ICT infrastructure at above mentioned locations.

1.5 EXPECTED OUTCOME OF THE PROJECT

The major expected benefits envisaged through this project are as follows:

2. INSTRUCTION TO BIDDERS

Bidders are advised to study this RFP document carefully before participating. It shall be deemed that submission of bid by the bidder has been done after their careful study and examination of the RFP with full understanding to its implications. Any lack of information shall not in any way relieve the bidder of its responsibility to fulfill its obligations under the Bid.

2.1 DEFINITION

In this document, the following terms shall have following respective meanings:-

“Acceptance” means the Assam Police Special Branch‘s written certification that following installation, the system(s) (or specific part thereof) has been tested and verified as complete and/or fully operational, in accordance with the acceptance test defined in the Acceptance Test Documents.

“Agreement” means the Agreement to be signed by the Implementation Partner and the Additional Director General of Police Special Branch, Assam.

“Authorized Representative” shall mean any person/agency authorized by either of the parties.

“Bidder” means any firm or group of firms or companies (called consortium) offering the solution(s), service(s) and/ or materials required in the RFP. The word

Bidder, when used in the pre-award period shall be synonymous with Bidder, and when used after intimation of Successful Bidder shall mean the Implementation

Partner, also called ‗Vendor or Implementation Partner‘, with whom Assam Police

Special Branch signs the Contract.

“Contract” is used synonymously with agreement.

“Documentary evidence” means any matter expressed or described upon any substance by means of letters, figures or marks intended to be used for the recording of that matter and produced before a court.

“GoA” shall mean Government of Assam.

“Law” shall mean any Act ,notification, bye law ,rules and regulations, directive, ordinance, order or instruction having the force of law enacted or issued by the

Government of India or State Government or regulatory authority.

“Party” shall mean Govt. or Bidder individually and “Parties” shall mean Govt. and Bidder collectively.

“PBC” means Pre-Bid Conference

“Rates/Prices” means prices of supply of equipment and services quoted by the

Bidder in the Financial Bid submitted by him and/or mentioned in the Contract

“RFP” means the detailed notification seeking a set of solution(s), service(s),

materials and/or any combination of them

“Services” means the work to be performed by the Bidder pursuant to this Contract, as detailed in the Scope of Work.

“Site” shall mean the location(s) for which the Contract has been issued and where the service shall be provided as per Agreement

“Tenderer” shall mean the authority issuing this Request For Proposal (RFP)/Tender and the authority under whom the Additional Director General of Police Special

Branch, Assam computerization project is to be implemented, operated, managed etc.

“Termination notice” means the written notice of “termination” of the

Agreement issued by one party to the other in terms hereof.

“ADGP” means Additional Director General of Police Special Branch, Assam.

“WAN” means Wide Area Network

“CLI” means Command Line Interface.

“FOR” means Free on Road

2.2 BIDDER'S GENERAL QUALIFICATION

An individual firm or a consortium shall submit the bid. The consortium shall be evaluated based on the total strength as evaluated in this bid document. However, if any of the member(s) is/are deleted or withdrawn after submission of the bid, the evaluation shall no longer be valid. In this situation the tenderer reserves the right to disqualify the consortium or re-evaluate. No new member can be included after the bid is submitted.

1. In case the consortium, applicant consortia shall have a Memorandum of

Understanding (MoU)/ agreement among all the members signed by the chief executive/ authorized signatories of the companies dated prior to the submission of the bid. The MoU/ agreement shall clearly state the stake of each member and outline the roles and responsibilities of each member. The MoU/ agreement shall be exclusively for this project and each member of the consortia shall be responsible in case of failure by any member.

2. In case of the consortia, all the members shall nominate a prime bidder. To the tender, prime bidder will be a single point of contact. The prime bidder will have to accept responsibility for all the liabilities and issues relating to this contract.

2.3 PRE-QUALIFICATION CRITERIA

1. The Bidder should have made a payment of Rs.10,000/- (Rupees Ten Thousand) only for the tender document in the form of Demand Draft / uncrossed IPO payable at Guwahati in favour of ―Additional Director General of Police, Special Branch,

Assam‖ and have submitted Bid Security / EMD amount of Rs. 10,00,000/- (Rupees

Ten Lakhs) only which shall be in Indian rupees and in the form of Irrevocable Bank

Guarantee / NSC / FDR of Bank duly pledged in favour of ―Additional Director

General of Police, Special Branch, Assam‖ from a scheduled bank and shall be valid for at least 180 days.

2. The respondents submitting their proposals should be a Company registered under the Indian Companies Act, 1956 and who have their registered offices in India. The company must be registered with the appropriate authorities for all applicable statutory taxes/duties.

3. The bidder should be in the business IT System Integration (SI) for at least last 5 years as of 31st March, 2013.

4. The Bidder should have minimum ISO certifications.

5. The Bidder shall not be under a declaration of ineligibility for corrupt or fraudulent practices.

6. The Bidder (Prime Bidder of the consortium) should have been profitable in the last three (3) financial Years (FY 10-11, FY 11-12, FY 12-13), as revealed by Audited accounts/certified balance sheet. The minimum annual turnover should not be less than 5 Crores of the bidder.

7. The Net Worth of the bidder must be at least Rs. 1.75 Crores as per the last audited Balance Sheet. The bidder must have a positive net worth in last three years

8. The Bidder must have an average annual turnover of Rs. 5 Crores or more in each of the last 3 financial years in India, as supported by Audited Accounts/ certified

Balance Sheet.

9. The bidder has executed 2 nos. of project of similar nature of order value minimum 2 Crores in single order involving desktop, laptop, peripherals, Networking items in last 5 years.

10. In order to enable the tenderer to authentically assess the bidders, the bidder will provide relevant, necessary documentary evidence in relation to the previous similar contracts executed by the bidder (e.g. Work orders)

11. Tenderer reserves the right to verify the details, if so desired.

12. The bidder should have company registration certificate, registration under

Labour laws – Contract Labour (Regulations and Abolition Act) Act, valid sales tax registration certificate, valid income tax registration certificate and valid service tax registration certificate

13. The Bidder should have bank‘s certificate of solvency (Min 1 Crore).

14. The bidder should have direct authorization from the Original equipment manufacturer (OEM) for selling and supporting the components offered under this project.

15. Bidder should clearly indicate, giving explicit supporting documentary evidence, with respect to the above, in absence of which their proposals will be rejected summarily at the qualification stage itself.

16. The bidder should have an office set-up in Assam with minimum 5 employees in its payroll for last 5 years. Bidder should submit the PF and ESI registration.

17. All the OEMs should give technical vetting of the product- solution quoted

with declaration for 5 years minimum support of the system.

NOTE: Please submit all the documentary evidence in support of the above conditions as part of the Pre- Qualification Criteria. In case of non compliance of Pre

Qualification criteria the bid of the bidder will be rejected

2.4 COST OF BIDDING

Bidder shall bear all costs associated with the preparation and submission of the Bid including surveys (if required), and Additional Director General of Police Special

Branch, Assam will in no case be responsible or liable for those costs, regardless of the conduct or outcome of the bidding process.

2.5 RFP DOCUMENT

Bidder is expected to examine all instructions, forms, terms, specifications, and other information in the RFP document. Failure to furnish all information required by the

RFP document or to submit a Bid not substantially responsive to the RFP document in every respect will be at Bidder‘s risk and may result in the rejection of its Bid

2.6 CLARIFICATION ON RFP DOCUMENT AND PRE-BID CONFERENCE

1. The bidders or their designated representatives are invited to attend the Pre–Bid

Conference (PBC) at their own cost at the following venue:-

2. In this PBC, Tenderer would address the clarifications sought by the bidders with regard to the RFP document and the project. The bidders would be required to submit their queries to Special Branch Assam Police Kahilipara, Guwahati. in writing or by

RFP (refer important information / queries should be as per Annexure 6). Queries not submitted within this deadline may not be taken up at the PBC.

3.Tenderer reserves the right not to respond to any/all queries raised or clarifications sought if, in their opinion and at their sole discretion, they consider that it would be inappropriate to do so or do not find any merit in it. The minutes of the PBC shall be circulated by tenderer to all those companies who have purchased this RFP document.

2.7 AMENDMENT OF RFP DOCUMENT

1.At any time prior to the deadline (or as extended by Additional Director General of

Police Special Branch, Assam) for submission of bids, Additional Director General of Police Special Branch, Assam for any reason, whether at its own initiative or in response to clarifications requested by prospective bidder may modify the RFP document by issuing amendment(s)

2. All bidders will be notified of the amendment(s) by publishing on the websites and these will be binding on them.

3. In order to allow bidders a reasonable time to take the amendment(s) into account,

Additional Director General of Police Special Branch, Assam at its discretion, may extend the deadline for the submission of bids.

2.8 LANGUAGE OF BID

The bid prepared by the bidder, as well as all correspondence and documents relating to the Bid exchanged between the bidder and the Additional Director General of

Police Special Branch, Assam shall be in English. Supporting documents and printed literature furnished by the bidder may be in another language provided they are accompanied by an accurate translation of the relevant pages in English. For the purposes of interpretation of the bid, the translation shall govern. Information supplied in another language without proper translation shall be rejected.

2.9 PERIOD OF VALIDITY OF BIDS

1. The bid shall remain valid for 180 days from the date of Technical Bid Opening being specified in this RFP. Bidder should ensure that in all circumstances, its Bid fulfils the validity condition. Any bid valid for a shorter period shall be summarily rejected.

2. In exceptional circumstances, Additional Director General of Police Special

Branch, Assam may solicit bidder‘s consent to an extension of the period of validity.

The request and the responses thereto shall be made in writing or by Fax. Bid

Security shall also be suitably extended. A bidder granting the request is neither required nor permitted to modify the bid.

2.10 FORMAT AND SIGNING OF BIDS

1. The bidder shall prepare required number of copies (original plus two copies) of the bid and shall clearly mark each ―Original Bid‖ or ―Copy of Bid‖ as appropriate.

In the event of any discrepancy between them, the original shall govern.

2. The original and all copies of the bid shall be typed or written in indelible ink and shall be signed by the bidder or a person duly authorized to bind the bidder to the bid. The person(s) signing the bid shall initial all pages of the bid, except for un- amended printed literature

3. The complete bid shall be without alteration or erasures, except those accorded with instructions issued by the Additional Director General of Police Special Branch,

Assam or as necessary to correct errors made by the Bidder, in which case such corrections shall be initiated by the person or persons signing the bid.

2.11 SEALING AND MARKING OF THE BID

Bidder shall submit their bids in FOUR PARTS, each in a separate sealed envelope

(wax sealed) super- scribed with the RFP document number, due date, time, Project name (Automation of Special Branch, Assam Police (ASB-AP)) and nature of bid

(bid security, Organizational capability, Technical bid or Financial Bid)

PART-I: The Bid Security Envelope needs to be super scribed as BID

SECURITY & Cost of RFP document.

PART-II: Original and 2 copies of PRE-QUALIFICATION details complete with all pre-qualification criteria. Envelope needs to be super scribed as “Pre-

Qualification – Additional Director General of Police Special Branch,

Assam”.

PART-III: Original and 2 copies of TECHNICAL BID complete with all technical details. Envelope needs to be super scribed as “Technical Bid – Additional

Director General of Police Special Branch, Assam”.

PART-IV: Original and 2 copies of FINANCIAL BID with full price details as given in Annexure 14. Envelope needs to be super scribed as “Financial Bid –

Additional Director General of Police Special Branch, Assam”.

The envelopes containing Part-I, Part-II, Part-III and Part-IV of offer shall be enclosed in a larger envelope duly sealed with wax and marked as Response to Request for

Proposal (RFP) with title and reference number, and a statement "To be opened by

addressee only” and the name and address of the Bidder. All the 4 envelopes shall be addressed to the

Please note that Special Branch Assam Police Kahilipara, Guwahati will not be responsible for any discrepancy, if exists between the hard copy and the soft version of the bid submitted by the bidders.

The outer and inner envelopes shall indicate the name and address of the bidder to enable the bid to be returned unopened in the case it is declared ―late‖ pursuant, and for similar purposes.

If the outer envelope is not sealed and marked as above, the Special Branch Assam

Police Kahilipara, Guwahati will bear no responsibility for the misplacement or premature opening of the Bid. Only detailed complete bids in the form indicated above received prior to the closing time and date of the bids shall be taken as valid.

Bids sent through E-mail shall not be acceptable.

2.12 BID DUE DATE

1. Bid must be received by Special Branch Assam, Kahilipara, Guwahati at the address and not later than the time and date specified at Important Sheet. Bids received after this deadline will be rejected and returned to the bidder unopened.

2. Special Branch Assam, Kahilipara, Guwahati may, at its discretion, on giving reasonable notice in writing by publishing on the specified websites and/or through press notification, to all bidders who have been issued the RFP documents, extend the bid-due-date, in which case all rights and obligations of the Additional Director

General of Police Special Branch, Assam, the bidder, subject to the provision biddue-date, shall thereafter be subject to the new bid due date or deadline as extended.

2.13 MODIFICATION AND WITHDRAWAL OF BID

1. The bidder may modify or withdraw its bid after submission, provided that written notice of the modification including substitution or withdrawal of the bids is received by the Additional Director General of Police Special Branch, Assam prior to the deadline prescribed for submission of bids.

2. The bidder's modification or withdrawal notice shall be prepared, sealed, marked and dispatched in the manner similar to the original bid.

3. No bid shall be modified subsequent to the deadline for submission of bids.

4. No bid may be withdrawn in the interval between the deadline for submission of bids and the expiration of the period of Bid validity specified by the bidder on the

Bid Form. Withdrawal of a Bid during this interval may result in the bidder's forfeiture of its Bid security.

2.14 LATE BID

Any bid received by the Additional Director General of Police Special Branch,

Assam after the bid due date mentioned at the Important Information sheet will be treated as “Late Bid” and rejected.

2.15 OPENING OF BID

1.

Special Branch Assam, Kahilipara will open bids (Part-I and Part-II) at the place and time mentioned at important Information sheet. Bidder‘s representatives

(Maximum 2) may attend the opening, and those who are present shall sign a register evidencing their attendance.

2. The bidder‘s names, bid modifications or such other details etc, the Additional

Director General of Police Special Branch, Assam at its discretion, may consider appropriate, will be announced at the time of opening.

3. The Evaluation Committee would evaluate the Pre-qualification criteria of the bidders. Implementation Partners will be informed subsequently.

4. Technical Bid will be opened for those bidders whose bids shall meet all the prequalification criteria. The place, date and time of opening of the Technical bids shall be notified separately through writing, mail or phone.

2.16 EVALUATION CRITERIA

Part 1 (Bid Security):

Bidders who have submitted the valid bid security as per the format shall be considered for further evaluation. Similarly if the RFP document fee has not been deposited / submitted in case of downloaded forms the Bid shall be out rightly rejected.

Opening of Prequalification Bid:

Special Branch Headquarters, Assam, Kahilipara will open envelopes containing the

Pre-Qualification Bid in the presence of Bidder‘s representatives who choose to attend on 05/04/2014 at 14:30 hours (Mentioned in Important Information section of the RFP) at the Office of the Special Branch Headquarters, Assam, Kahilipara,

Guwahati-781019. The Bidder‘s representatives, who are present, shall sign in a register evidencing their attendance. In the event of the specified day of bid opening being declared holiday for the Additional Director General of Police Special Branch,

Assam, the bid shall be opened at the appointed time and location on the next working day or the day notified by the Additional Director General of Police, Special

Branch, Assam.

Opening and Evaluation of Technical Bids

The Evaluation Committee would evaluate the technical bids. The Additional

Director General of Police Special Branch, Assam may also undertake oral clarifications with the bidders. The primary function of clarifications in the evaluation process is to clarify ambiguities and uncertainties arising out of the evaluation of the bid documents.

19. A duly constituted Technical Evaluation Committee (TEC) will first select Bidders on the basis of Pre Qualification criteria of this tender.

The Bids conforming to the Pre Qualification criterion will be considered for further evaluation.

20. AP has the option to ask the bidders to arrange demonstration of the offered systems, in a short period notice at their own cost; as such the bidders have to be ready for the same.

21. In this part, the technical bid will be reviewed for determining the eligibility of the Bidder for the Project and to ascertain Compliance of the Technical bids with the Tender terms and conditions, technical requirements and scope of work as defined in this tender.

22. Bidder can be asked to submit additional information for clarification with regards to technical bid. In case of no response by the Bidder to any of the requirements with regard to the contents of the Technical

Bid, he shall not be assigned any marks for the same. No missing information can be provided by the Bidder.

23. Technical bid of the bidder shall be opened and evaluated for acceptability of Techno-functional requirements, deviations and technical suitability. Bidders shall respond to the requirements as explained in 16 -25: Technical Formats, for their evaluation with regard to experience and qualification. Also, Bidder shall refer and respond to ALL technical requirements as mentioned in the tender document. The evaluation process would also include a presentation of technical proposal by the Bidder.

24. For Technical Evaluation, Bidders have to ensure the availability of appropriate specialist from their organization for interacting with TEC and evaluation team.

25. Financial bids of only technically qualified Bidders will be opened in their presence. Total marks that can be scored in Technical Evaluation are 10000. Overall minimum 70% marks i.e. 7000 are required to qualify the technical evaluation. The technical solution hold 6000 marks out of the above mentioned 10000 marks. A minimum of 80% marks i.e.4800 marks should be scored in the technical solution to qualify technical bid.

2.17 QUALITY CUM COST BASED SELECTION (QCBS) METHODOLOGY

1. The Financial Bids of only pre-qualified and technically qualified bidders will be opened physically in the presence of their representatives on a specified date and time duly notified .

2. Lowest Quoting Bidder will be the one who has quoted the lowest.

3. In the event the L1 bidder does not accept the contract, EMD of the bidder will

be forfeited and AP may go for the next L2 or tender may be scrapped.

4. No enquiry shall be made by the bidder(s) during the course of evaluation of the tender, after opening of bid, till final decision is conveyed to the successful bidder(s). However, the Committee/its authorized representative and office of

AP can make any enquiry/seek clarification from the bidders, which the bidders must furnish within the stipulated time else bid of such defaulting bidders will be rejected.

5. The commercial bids shall be evaluated by the Purchaser for completeness and accuracy. Arithmetical errors will be rectified on the following basis. If there is a discrepancy between the unit price and the total price that is obtained by multiplying the unit price and quantity, the unit price shall prevail and the total price shall be corrected. If there is a discrepancy between words and figures, the amount in words will prevail.

A.Technical Bid: The threshold score for technical qualification would be 70 out of marks 100 based on the evaluation method. Any proposal achieving a Total Technical

Score (T) less than 70 i.e TB% less than 49% will be treated as Not Substantially

Responsive and will not be considered further. Only the technically qualified bidders will be informed for opening of the commercial bid. No further discussion/interface will be held with the bidder whose bid has been technically disqualified / rejected.

Technical bid weight age will be calculated as TS (Technical Score) %=( technical points of the Bidder/100)*0.7

B.Commercial Bids: Commercial bids of those bidders who qualify the technical evaluation will only be opened. All other Commercial bids will be returned un-opened.

The place, date and time for the opening of the financial bids shall be announced separately to only technical qualified bidders

Commercial bid weight age will be calculated as CS (Commercial Score)%=( L1 price/bider’s quoted price/)*100

The selection of the bidders shall be based on Quality cum Cost Based Selection

(QCBS) methodology i.e. the aggregate scores of the technical bid (70%weightage) and

Commercial bids (30% weightage) will be made. The Bidder with the highest aggregate

score will be declared as L1 and will be required to further enter into contract with department.

Opening and Evaluation of Financial Bids

After evaluating the Technical Bids, Additional Director General of Police Special

Branch, Assam shall notify the bidders, indicating the date, time and place for opening of the Financial Bids. The following points may be noted for the evaluation of the Financial Bid

• Prices shall be written in both words and figures. In the event of difference, the price in words shall be valid and binding.

• Arithmetical errors will be rectified on the following basis. If there is a discrepancy between the unit price and the total price that is obtained by multiplying the unit price and quantity, the unit price shall prevail and the total price shall be corrected. If the Bidder does not accept the correction of the errors, its bid will be rejected. If there is a discrepancy between words and figures, the amount in words will prevail.

• Any discrepancy relating to prices quoted in the offer across different sections of the bid, only prices given in the prescribed format given at

Annexure- 11 of this RFP shall prevail.

The Bidder with the lowest Financial Proposal would be considered as the L1

Bidder and would be awarded a commercial score of 100. Commercial Scores

(CS) for other technically qualified bidders will be evaluated using the following formula:

Commercial bid weight age will be calculated as CS (Commercial Score)%=( L1 price/ bider’s quoted price)*100

Commercial Scores (CS) will carry a weightage of 30%. Therefore, the total score will be calculated as below:

Total Score= TS+0.30*CS

The Special Branch Assam, Kahilipara, Guwahati reserves the right to negotiate with the successful Bidder.

2.18 BID CURRENCY

Prices for services offered shall be quoted in Indian National Rupees only.

2.19 BID SECURITY

1.All bidders shall furnish, as part of its Pre-Qualification Bid, a Bid Security amounting to

Rs. 10,00,000.00 (Rupees Ten Lakhs Only

). Bids without this bid security will be rejected.

2. The Bid Security shall be in Indian Rupees and shall be in the form of Irrevocable

Bank Guarantee / NSC / FDR of Bank duly pledged in favour of ―Additional

Director General of Police, Special Branch, Assam‖ from a scheduled bank and shall be valid for at least 180 days.

3. Unsuccessful bidder‘s Bid security will be discharged or returned within

sixty (60) days

after the expiration of the period of Bid validity prescribed.

4. The successful bidder‘s Bid security will be discharged upon the bidder signing the Contract Agreement, and furnishing the Performance Security.

5. Bid security deposited with the tender shall bear no interest.

2.20 FORFEITURE OF BID SECURITY

The Bid security may be forfeited either in full or in part, at the discretion of the

Additional Director General of Police Special Branch, Assam, Kahilipara, on account of one or more of the following reasons:

1. If the bidder withdraws its Bid during the period of Bid validity specified by it on the Bid Letter Form;

2. If the bidder fails to co-operate in the Bid evaluation process

3. If the bid or its submission is not in conformity with the instruction mentioned herein

4. If the bidder violates any of the provisions of the terms and conditions of the tender

In case, a successful bidder fails to (a) accept award of work, (b) sign the Contract

Agreement with the Additional Director General of Police Special Branch, Assam within the stipulated time after acceptance of communication on placement of award,

(c) furnish performance security, (d) fails to sign the Contract Agreement in time, (e) or the bidder violates any of such important conditions of this tender document or indulges in any such activities as would jeopardize the interest of Additional Director

General of Police Special Branch, Assam in timely finalization of this tender. The decision of the Additional Director General of Police Special Branch, Assam regarding forfeiture of bid security shall be final and shall not be called upon question under any circumstances. A default of such type or nature may involve black-listing of the bidder by Additional Director General of Police Special Branch,

Assam.

2.21 AWARD OF CONTRACT

The Additional Director General of Police Special Branch, Assam will award the contract to the successful bidder whose bid has been determined to be responsive and has been determined to be most competitive and thus selected.

2.22 PERFORMANCE SECURITY

Within 15 (Fifteen) days of Notification of ―Award of the Contact‖ the company shall furnish Performance Security to Additional Director General of Police Special

Branch, Assam @ 15 % of the total value of quoted bid by way of irrevocable and unconditional Bank Guarantee / NSC / FDR of Bank in favour of Special Branch

Assam, Kahilipara, Guwahati for a period to be specified in the award of work. The proceeds of the Performance Security shall be payable to Additional Director General of Police, Special Branch, Assam as compensation for any loss resulting from the

Company‘s failure to fulfil its obligations under the terms and conditions of the Work

Order including warranty period of three years.

Performance Security will not accrue any interest.

2.23 RIGHT TO ACCEPT BID AND TO REJECT ANY OR ALL BIDS

1. Prior to expiration of the period of Bid validity, Additional Director General of

Police, Special Branch, Assam will notify the successful bidder in writing that its Bid has been accepted.

2. Within 15 days of receipt of such intimation, the successful bidder shall give its acceptance to the Additional Director General of Police Special Branch, Assam

3. Effort will be made by the Additional Director General of Police Special Branch,

Assam, Kahilipara to sign an agreement with the successful bidder within 30 days.

2.24 ACKNOWLEDGE OF INFORMATION TO BIDDER

The bidder shall be deemed to have carefully examined RFP document to his entire satisfaction. Any lack of information shall not in any way relieve the bidder of his responsibility to fulfil his obligation under the bid.

2.25 FRAUDULENT & CORRUPT PRACTICE

“Fraudulent Practice” means a misrepresentation of facts in order to influence a procurement process or the execution of the project and includes collusive practice among bidders (prior to or after Bid submission) designed to establish Bid prices at artificial non-competitive levels and to deprive the Additional Director General of

Police Special Branch, Assam, Kahilipara of the benefits of free and open competition.

“Corrupt Practice” means the offering, giving, receiving or soliciting of anything of value, pressurizing to influence the action of a public official in the process of project execution. The Additional Director General of Police Special Branch,

Assam will reject a proposal for award if it determines that the bidder recommended for award has engaged in corrupt or fraudulent practices in

competing for, or in executing, the project.

3. GENERAL CONDITIONS

3.1 APPLICATION

These general conditions shall apply to the extent that they are not superseded by provisions of other parts of the bid document.

3.2 GOVERNING LANGUAGE

The Contract shall be written in English language. All correspondence and other documents pertaining to the Contract, which are exchanged by the parties, shall be written in the same language.

3.3 APPLICABLE LAW

The Contract shall be interpreted in accordance with the laws of the Gauhati High

Court will be the exclusive jurisdiction to determine any proceeding in relation to this contract.

3.4 CHANGE ORDERS

1. The Additional Director General of Police Special Branch, Assam may at any time, give written order to the Implementation Partner to make changes for additional functionalities specifically required for the project, but not falling within the general scope of the Project.

2. Any claims by the Implementation Partner for adjustment under this clause must be asserted within 7 working days from the date when the change order is placed by the ADGP.

3. The Purchaser and the Vendor may incorporate changes / amend the contract on mutual agreement at any time during the contract agreement period in public interest.

3.5 TAXES AND DUTIES

1. All the taxes, duties, levies and all other charges applicable shall be valid for delivery on FOR basis to the designated delivery points. All payments will be

subjected to tax deduction at source as applicable/required at the prevailing tax rates.

2. The Additional Director General of Police Special Branch, Assam shall not pay any increase in duties, taxes and surcharges and other charges on account of any revision, enactment during the period of validity of the Bids and also during the contract period. The decision of Additional Director General of Police Special

Branch, Assam , Kahilipara in this regard will be final and binding and no disputes in this regard will be entertained.

3.6 INSURANCE

Implementation Partner shall acquire and maintain insurance coverage during the managed IT services period of 3 years from the date of acceptance that are standard and customary in the industry to protect Additional Director General of Police

Special Branch, Assam and the total system from any losses, damages including but not limited to the damages during transit or claims. The Additional Director General of Police Special Branch, Assam has the right to inspect all such policies.

3.7 PACKING

1. The Implementation Partner shall provide packing of systems in such a manner as to prevent their damage or deterioration during transit to the project sites. The packing shall be sufficient to withstand, without limitation, rough handling during transit and exposures to extreme temperatures, humidity, sleet and precipitation during transit and open storage.

2. The Implementation Partner shall promptly replace any system that is damaged in transit. The packing, marking and documentation within and outside the packages shall also comply strictly with the requirements.

3. There shall be a packing list, in each case, fully itemized to show case number, contents, gross and net weight and cubic measurement.

3.8 DIFFERING SHIPMENTS

If the Additional Director General of Police Special Branch, Assam has effectively notified the Implementation Partner in writing that the former is not ready to take delivery, no system or materials shall be forwarded until intimation in writing has been given to the Implementation Partner (SI) by the Additional Director General of

Police Special Branch, Assam that it is ready to take delivery.

3.9 DELIVERY AND DOCUMENTATION

It is the responsibility of the Implementation Partner to supply all the Hardware and

networking equipments, as mentioned in the schedule of requirements in the respective project sites. The Implementation Partner shall intimate the Additional

Director General of Police Special Branch, Assam by letter/fax/email/Telephone, at least 7 days before the actual arrival of the systems at the Site, the full details of the delivery including contract number, couriers receipt number and date, description of systems, quantity etc. The Implementation Partner shall mail the following documents to the Additional Director General of Police Special Branch, Assam –

3 copies of the invoice showing systems description, quantity, unit price, total amount

Courier‘s receipt/acknowledgement of receipt of systems

Insurance certificate

Manufacturer‘s/Supplier‘s warranty certificate

Factory Inspection Certificates.

3.10 FORCE MAJEURE

1. For the purpose of this Article, Force ―Majeure‖ means any clause, which is beyond the control of the S.I. or Govt of Assam (Assam Police, SB) as the case may be, which such party could not forsee o with a reasonable ampont of diligence could not have forseen, and which substantially affect the performance of the Contract, such as:

- War/ hostilities

- Riot or civil commotion

- Earthquake, Flood, Fire, Tempest, Epidemics, Lightining or other natural physical

Disaster, Quarantine restricts and Freight embargoes

- Restrictions imposed by the Government or other statutory bodies, which is beyond the control of the S.I, which prevent or delay the execution of the order by the S.I.

2. If a Force Majeure situation arises, the S.I is required to promptly notify Assam Police

Special Branch in writing of such condition and the cause thereof within a period of three (3) days from the date of happening of such an event requiring invocation of this force majeure article. Unless otherwise directed by Assam Police Special Branch in writing, the S.I will continue to perform its obligations under this supply order as far as is reasonably practical and shall seek all reasonable alternative mans for performances of this order.

Force Majeure Exclusions :

Force Majeure shall not include the following event(s) and/or circumstances, except o the extent that they are consequences of an event of Force Majeure:

(i) Unavailability,late delivery, or changes in cost of machinery, equipment, materials, spare parts etc.

(ii) Delay in the performance of any contracto, sub- contractors or their agents.

(iii) Non-performance resulting from normal wear and tear of the materials and equipment; and

(iv) Non- performance caused by, or connected with, the Affected Party‘s

- negligent or intentional acts, errors or omissions; and/or

- failure to comply with an Indian law or Indian Directive ; and /or

- breach of, or default under the Agreeemnet.

Procedure for Calling Force Majeure :

The Affected Party shall notify to the other Party in writing of the occurrence of the Force

Majeur as soon as reasonably practicable, and in any event within 5 (five) days after the

Affected Party came to know or ought reasonably to have known, of its occurrence and the

Force Majeur would be likely to have a material impact on the performance of its obligations under the Agreement.

Any notice pursuant this clause shall include full particulars of:

(i) The nature of each Force Majeure which is the subject of any claim fo relief under the Agreement;

(ii) The effect which such Force Majeure Event is having or is likely to have on the Affected Party‘s performance of its obligations under the

Agreement;

(iii) The measures which the Affected Party is taking, or proposes to take, to alleviate the impact of the Force Majeure Event and restore the performances of its obligations under the Agreement which are affected; and

(iv) Any other information relevant to the Affected Party‘s claim

Procedure for Claiming Relief :

(i) Where an Affected Part claims relief on account of Force Majeure Event then, the rights and obligations of both Parties under the Agreement shall be suspended to the extent that they are affected by such Force Majeure Events.

(ii) In an Event of Force Majeure:

a) The Affected Party shall use its best efforts to minimise the effects of Force Majeure and remedy any inability due to

Force Majeure; b) The Affected Party shall provide weekly written reports to the other Party regarding its progress in overcoming the adverse effects of the Force Majeure event; c) The Affected Party shall, as soon as reasonably practicable after claiming such relief, provide the other Party with written notice containing such information as may be reasonably required to justify the claim for relief due to

Force Majeure; d) The Affected Party shall claim in respect of physical loss or damage resulting from the event constituting Force Majeure which are available from Insurance pursuant to any

Insurance maintained by the Affected Party and ensure such claims are made as soon as is reasonably possible and that the proceeds of any such Insurance claims are applied to remedy the effects of the event constituting Force Majeure as soon as is reasonably possible; and e) The Affected Party shall, at its own cost, take all steps reasonably required to restore its ability to perform its obligations under the Agreement as soon as possible, including the re-commissioning of any affected part of the within the scope of work.

(iii) When the Affected Party is able to resume performance of its obligations under the

Agreement, it shall promptly give the other Party written notice to the effect. In no event shall the suspension of performance b of greater scope and of no longer duration than is necessitated by Force Majeure.

Extensions due to Force Majeure :

Neither Party shall be responsible or liable for, or deemed to be in breach of the Agreement because of any failure or delay in complying with its obligations under the Agreement, due to solely to one or more events of Force Majeure, and the periods allowed for the performance by the Parties of such obligation(s) shall be extended on a day-for-day basis from the date of

the event of Force Majeure provided that no relief shall be granted to the Affected Party to the extent that such failure or delay would have nevertheless been experience by the Party had such Force Majeure event not occurred.

Termination as result of Exceptional Event :

Notwithstanding anything contained herein, in case the period of Force Majeure lasts for more than 3 (three) months from the occurrence of the event of force majeure, whether such force majeure event occurs before or after commissioning of the Project, either party shall have the right to terminate the Agreement by a written notice of 15 (fifteen) days to the other party.

The S.I. shall give notice to the Assam Police Special Branch of:

(i) The cessation of the event circumstance of Force Majeure being claimed; and

(ii) The cessation of the effects of the event or circumstance of Force

Majeure being claimed on the enjoyment by such Party of its rights or the performance of its obligations pursuant to the Agreement, as soon as possible after becoming aware thereof.

3.11 SETTLEMENT OF DISPUTES

All disputes or differences whatsoever arising between the parties out of or relating to the construction, meaning and operation or effect of the contract or the breach thereof shall be settled either by (i) Mutual Consultation or (ii) through an Outside Expert Committee (OEC) to be appointed by Assam Police HQ, and cost to be borne by both the parties, in case the mutual consultation fails to arrive at an amicable solution or (iii) through Arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 and any statutory modifications or re-enactments thereof and rules made there under and for the time being in force shall apply to the arbitration proceedings. The venue of arbitration shall be

Guwahati.

3.12 TERMINATION

1. Termination for Default: If the bidder fails to carry out the award / work order in terms of this document within the stipulated period or any extension thereof, as may be allowed by Additional Director General of Police Special Branch, Assam, without any valid reasons acceptable to the Additional Director General of Police Special

Branch, Assam may terminate the contract after giving one month notice, and the decision of Additional Director General of Police Special Branch, Assam on the matter shall be final and binding on the bidder. Upon termination of the contract,

Additional Director General of Police Special Branch, Assam shall be at liberty to get the work done at the risk and expense of the bidder through any other agency, and to recover from the bidder compensation or damages.

2. Termination for Insolvency: Govt of Assam (GoA) can terminate the contract if the bidder becomes bankrupt and/or losses the desired state of insolvency with a notice of 15 days. GoA in such cases of termination will not be responsible for any loss or financial damage to the service provider resulted due to the termination. The

Government will also, in such cases have the right to recover any pending dues by invoking the performance bank guarantee or any such instrument available with the

Government.

3.13 ACQUAINTANCE WITH LOCAL CONDITIONS

1. The Vendor is expected to fully get acquainted with the local conditions and factors, which would have any effect on the performance of the contract and /or the cost.

2. The Vendor is expected to know all conditions and factors, which may have any effect on the execution of the contract after issue of Letter of Intent/Award as described in the bidding documents. The Additional Director General of Police

Special Branch, Assam shall not entertain any request for clarification from the vendor regarding such local conditions.

3. It is the Vendor‘s responsibility that such factors have properly been investigated and considered while submitting the bid proposals and no claim whatsoever including those for financial adjustment to the contract awarded under the bidding documents will be entertained by the Additional Director General of Police Special

Branch, Assam. Neither any change in the time schedule of the contract nor any financial adjustments arising thereof shall be permitted by the Additional Director

General of Police Special Branch, Assam on account of failure of the Vendor to know the local laws / conditions.

3.14 STATUTORY AND REGULATORY APPROVALS

The Vendor shall be responsible for obtaining approvals for any statutory and regulatory requirements from any of the authorities. Further, the vendor shall be responsible to get required documentation completed for obtaining such approvals from time to time.

3.15 CONFIDENTIALITY

Any information pertaining to the Additional Director General of Police Special

Branch, Assam or any other agency involved in the project, matters concerning Govt of Assam that comes to the knowledge of the Implementation Partner in connection with this contract, will be deemed to be confidential and the Implementation Partner will be fully responsible, for the same being kept confidential and held in trust, as also for all consequences of its concerned personnel failing to observe the same. The

Implementation Partner shall ensure due secrecy of information and data not intended for public distribution.

4. SCOPE OF WORK

The scope of work with respect to hardware and networking for Computerization of business processes in SB Assam, Assam is presented below.

The SB Assam, shall have the right to execute the scope of work as mentioned in the following sections or as modified during finalization of this contract in part or whole.

The client at its sole discretion at any point of time may extend or reduce the scope of work with a written notice to this effect.

4.1 SITE PREPARATION & VISIT

1. The respective Authorities in the SB Office shall provide the necessary minimum constructed space for locating the systems (Server room of min 150 sq ft area) purchased under the project.

2. The entry and exit to the site for the equipment and personnel for the bidder shall be in accordance with security rules and regulations, which may apply to the premises, where the zonal offices are located.

4.2 SCOPE OF SUPPLY

Supply of all the products and equipments (active and passive) specified in Bills of

Material as final at their appropriate quantity and capacity at their respective sites

(Head Office & District Offices). Items should be nationally branded with their OEM certificates. It will be inclusive of but not limited to –

1. Timely delivery to five locations (including Guwahati HO) as per the agreed timelines with the Additional Director General of Police Special

Branch, Assam

2. Transporting the items – no extra / additional charges (road tax, excise, toll tax, insurance, etc.) would be considered for payment

3. Safety – The Implementation Agency would be responsible for maintaining adequate safety measure at the storage points. Depending upon the availability and suitability, appropriate location for storage would be provided by the Additional Director General of Police Special Branch,

Assam on prescribed charges. The Additional Director General of Police

Special Branch, Assam would not be responsible for any losses due to theft, fire or any exigencies in this regard.

4. The Implementation Agency would need to get the factory acceptance test for the products listed in the bills of material or agreement and provide documentary evidence for the same to the Additional Director General of

Police Special Branch, Assam.

5. The bidder must not supply bid/supply any equipment that it likely to declared end of sale within three years from the date of supply. The bidder would have to replace any such equipment with at least the equivalent or higher configuration.

6. Supply of all such material e.g., nuts, screws, wires etc. necessary for installation of the systems has to be provided by the Implementation

Agency

7. It is expected that the Implementation Agency would undertake necessary inputs from similar assignments as learning have and will be inclusive in the total costing.

8. The Implementation Agency shall provide a total of four years of O&M phase which includes a minimum of three years of standard warranty and one years of on-site maintenance post completion of standard warranty.

4.3 SCOPE OF INSTALLATION, COMMISSIONING AND INTEGRATION

The Implementation Agency is responsible for all unpacking, assemblies, wiring, installations, cabling between hardware units and connecting to power supplies. The

Implementation Agency will test all hardware operations and accomplish all adjustments necessary for successful and continuous operation of the hardware at all installation sites.

1. Installation of all active and passive components and accessories supplied under this Project and configuring it.

2. Installation, integration and commissioning of Local Area Networks at implementation locations as per the requirements

3. Configuring and fine tuning of sub-systems to achieve overall optimal network performance and highest security

4. The components to be installed would include but not limited to: i. PCs and peripherals ii. Routers iii. Switches iv. Passive components like patch panels, I/O outlets, etc v. Any other software besides the standard software and Server

Operating System vi. The Desktop and Laptop will be from same OEM vii. The routers and switches will be from same OEM viii. Integration of all existing LAN/WAN links to provide enterprise wide access to resources and services.

5. The Implementation Agency also needs to take care of all IP addressing or similar issues arising at the time of integration and should also ensure that the existing systems run smoothly

6. To bring all the installation equipments and tools required for installation and commissioning of systems without any extra cost

7. To provide all patches and updates during the duration of the contract

8. To carry out all general test such as power test on delivery, pre-installation

check to ensure correct connection etc.

9. To install and commission structured LAN cabling within the implementation location involving CAT 6 cables, surface mount I/Os, patch codes, jack panels, any other components

10. Testing is conformance to measurement procedures and test parameters for

CAT 6e and other communication cables installation as defined in TIA/EIA-

568-B standards, of each node at each site. The certified test results are to

be submitted to the SB HQ Kahilipara, Assam in HARD COPY.

4.4 HELP-DESK SUPPORT

1. The Implementation Agency is required to set up Help-desk Support Facility at the state level – i.e. Head Quarter Office of Additional Director General of Police

Special Branch, Assam in Guwahati

2. It is expected that for Help-desk Support a minimum of 2 Service Engineers resources will be deployed who are technically competent to handle all technical issues including but not limited to trouble shooting, resolution of service tickets of various priorities, SLA monitoring, etc. as well as reporting and monitoring, and other administrative requirement of the state.

3. The Additional Director General of Police Special Branch, Assam would provide required space to Service Engineers if necessary and it is expected that these Service

Engineer would be available on-site with 12x6 (12 hours- 8.00 AM – 8 P.M. and six day for a week – Monday to Saturday) uptime for the entire contract period of 5 years.

4. The Help-desk Service Engineer personnel shall act as a single point interface to

Additional Director General of Police Special Branch, Assam for: i. Troubleshooting and providing LAN solutions ii. Maintaining a repository of issues and events iv. The following are the minimum requirements for the help desk:

5. Minimum of 2 Service Engineers with sufficient technically competency who can

resolve the technical issues related to Hardware i. Sufficient spare parts should be available with the Service Engineer staff to replace the any defective/non-functional Hardware seamlessly. ii. A monthly, quarterly and yearly summary of problems and issues, categorized and classified appropriately must also be shared with Additional Director General of

Police Special Branch, Assam

6. Additional Director General of Police Special Branch, Assam will not provide any other facilities like land-line telephone facility, desktops etc to the Service Engineer

Personnel. The service engineers shall arrange these facilities on their own.

7. The Implementation Agency will be required to adhere to SLAs regarding the required uptime for maintaining the quality of service.

4.5 SCOPE OF WARRANTY & MAINTENANCE

1. During the warranty period, Implementation Agency warrants that the goods supplied under the contract are new, unused, of the most recent version/models and incorporate all recent improvements in design and materials unless provided otherwise in the contract. The Implementation Agency further warrants that the system and overall solution supplied to the Additional Director General of Police

Special Branch, Assam, shall have no defect arising from design, material of workmanship or any act or omission.

2. The warranty of the hardware and the networking components shall remain valid

for a period of three years from the date of Final Acceptance Test.

3. The Implementation Agency would provide free software upgrades during the warranty period from the date of acceptance for all software components like operating system, management software, anti-virus software, or any other software which would be a part of supplies

4. The Implementation Agency shall provide Operations & Maintenance for a

total period of Five years (Three years of warranty and Two years of on-site

O&M) from the date of Final Acceptance Test.

5. Operations & Maintenance would include maintenance for the overall system stabilization, hardware maintenance and system maintenance.

6. The operational support will have to be provided at all Zones through a suitable help-desk support, to ensure that the solution is functioning and that all problems associated with operation are resolved satisfactorily.

4.6 SCOPE OF CONNECTIVITY

The requisite WAN connectivity which is 4/8 MBPS Leased Line from

BSNL/PGCIL/RAILTEL shall be arranged and paid by the SB through the selected

SI. The SB HQ, CID HQ and Border Police HQ will be connected with 4/8 MBPS leased line point to point from NIC Dispur. The internet bandwidth will be provided by NIC free of cost. However SB through the selected SI will pay for the last mile connectivity to the TSP. The successful bidder will however have to assist SB for the same and also co-ordinate/ liaison with BSNL PGCIL/RAILTEL for the timely commissioning and maintenance of the connectivity. Additionally the bidder has to perform the following jobs. The last mile leased line cost cost shall be included by the bidder in the bid document. i) Monitor the connectivity of SB, Assam using Network management software. ii) Lodge a call with BSNL/PGCIL/RAILTEL in case of link breakdown. iii) Liaison with BSNL/PGCIL/RAILTEL in an active way to restore the fault in early time.

The Additional Director General of Police Special Branch, Assam also requires having additional back-up connectivity. This link will be a Wireless point to

point from NIC Dispur to the SB HQ at Kahilipara.

The Implementation agency will require establishing a 10 MBPS wireless

Connectivity at all the above 30 district headquarters locations and one at the

SB HQ Kahilipara which will act as a backup to the leased line. The overall supply of equipments, implementation, and maintenance will remain with the implementing agency. Additionally few more 10 MBPS wireless connectivity from

NIC Dispur to the following locations have to be connected,

1. CM Residence, Koinadhara

2. Assam Police HQ, Ulubari

3. Police Control Room, Ulubari

4. Commissioner of Police (behind Panbazar Police Station)

4.7 SCOPE OF TRAINING

i) The successful bidder shall provide comprehensive training for operation and management of this network to the personnel identified for the Additional Director

General of Police Special Branch, Assam. The number of personnel required to be trained are to be specified by the Additional Director General of Police Special

Branch, Assam. The training should cover system design, installation, configuration, set-up, administration, testing, management up-gradation and maintenance of all the equipment (hardware and software) supplied. This Training shall be held at the location(s) identified by the ADGP (Additional Director General of Police Special

Branch, Assam).

ii) The successful bidder shall impart hands-on training iii) With detailed course material on the installed network covering at least the following:

System configuration and network architecture

Network Management System (NMS)

Security management components

Network usage policies, procedures and SLA management

Configuring & fine tuning

Administration and Management

Operations & Monitoring

Availability and Service continuity Management iv) This training should cover the day-to-day maintenance, management, and operations related aspects of the routers, switches, servers, related system software and UPS etc. v) The training modules and their duration shall be finalized in consultation with the

Additional Director General of Police Special Branch, Assam. vi) The Successful Bidder shall also supply detailed training material to state, to enable them to train more number of officers independently.

4.8 SCOPE OF APPLICATION DEVELOPMENT AND TRAINING

Since the works of Special Branch (SB) is very confidential in nature and related to safety and security of the state, different organizations and VVIP/vulnerable persons, it is decided to develop necessary software for this automation project through a reputed govt. agency which has expertise, and therefore, in the present case it will be done through NIC/NICSI. NIC/NICSI is to design and develop the application software on the basis of System Requirement Study (SRS) and Functional

Requirement Study (FRS). The customized application software would be developed for enabling IT based information system at various levels of the Additional Director

General of Police, Special Branch, Assam. The software would cover functional as well as reporting requirements of the Additional Director General of Police, Special

Branch, Assam. Once the application is developed, the application will have to be audited for functional and non-functional aspects for hosting through the State Data

Centre as mandated by Government of India. After completion of mandated tests and compliance, there would be a need for the application to be made online which would be audited for improvement in the system usability, design, maintainability and ensuring the system is closer to users‘ need. While achieving these objectives, if it stems out that application needs design tuning and IT infrastructure up gradation in respect of Servers etc., the change in the existing software application need to be carried out by the successful bidder selected for the purpose. The entire

cost required for the development of the software for this office automation project shall be paid to NICSI as a part of the deal by the Assam Police (SB) directly subject to the approval of the Govt. of Assam. NICSI/NIC will only charge for the necessary manpower needed for the development as per the

NICSI standard.

It should be noted that suitable penalty, mentioned under ‗Penalties‘ clause of this

RFP would be charged to the implementation partner in case of delay from their end and would be finalized in the contract. It may be noted that T1 is the event marking the Tenderer signing the Agreement with the Implementation Agency. G1 is the date of successful acceptance of the installation and commissioning of the project.

6.2 PAYMENT TERMS

The selected Implementing Agency/SI (Bidder) shall be paid on completion of milestones that has been approved and accepted by Project Steering Committee and endorsed by Additional Director General of Police Special Branch, Assam at the rates specified by the bidder and agreed upon. Additional Director General of Police

Special Branch, Assam shall make a payment after the successful implementation of every milestone of any given phase when the bidder claims for payment with the following supporting document:

1. Approval letter from the Project Steering Committee for the milestone achieved.

2. Acceptance certificate for the sites accepted by Additional Director General of

Police, Special Branch, Assam.

3. SLA compliance report as prepared by the Implementing Agency.

4. All supporting documents like the bills, invoices etc.

6.3 PAYMENT SCHEDULE

1. No advance payment will be made in any circumstances.

2. All the payments to the Implementation Agency will be made as per the Payment

Schedule and Terms of Payment set out in this RFP, upon submission of invoices along with relevant Sign Off from the Project Steering Committee.

3. In the event of premature termination of the agreement prior to the launch of the

Project, the Implementation Agency shall not be eligible to receive any compensation or payment. Further, appropriate penalty would be imposed on the Implementation

Agency as decided by the Additional Director General of Police Special Branch,

6.8 PENALTIES FOR DELAY IN IMPLEMENTATION

If the Project Implementing agency/System Integrator (SI) fails to complete the specified milestones within the time period (s) specified in the implementation plan,

Additional Director General of Police Special Branch, Assam, Government of Assam may, without prejudice to its other remedies under the Agreement, levy as Penalties, a sum equivalent to 0.25 % per week of the arithmetic sum of the amount of the milestone.

6.9 ACCEPTANCE TESTING

1. The primary goal of Testing & Acceptance is to ensure that the project meets requirements, standards, specifications and performance prescribed by the tender

2. Completion of any other tests/evaluation criteria that State Project Implementation

Agency may specify.

3.The Acceptance Tests for the Software, Hardware and Networking Components shall involve successful supply, delivery at site, installation and commissioning of systems at all implementation locations of the project.

4. In the event of the site not being allocated by the Additional Director General of

Police Special Branch, Assam, the Implementation Agency and the Additional

Director General of Police Special Branch, Assam may mutually agree to redefine the milestones.

5. On the successful completion of the Acceptance Test and after the Committee so constituted by the Additional Director General of Police Special Branch, Assam to conduct the said Acceptance Tests are satisfied with the working of the system, the

acceptance certificates, signed by the Implementation Agency and authorized representative(s) of Additional Director General of Police Special Branch, Assam.

Any delay by the Implementation agency in the performance of its contracted obligations shall render the Implementation agency, liable to the imposition of appropriate penalties, unless agreed otherwise by the Additional Director General of

Police Special Branch, Assam.

6. All components of the solution, for hardware, networking components, software and other peripherals, as the case may be, would be deemed accepted on attainment of the receipt of Site Acceptance Certificate from each Location.

7. Any delay attributable to the Implementation Agency in the Acceptance Testing shall render the Implementation Agency liable to the imposition of appropriate penalties, as mentioned in the document.

7. ROLES AND RESPOSIBILITIES

7.1

RESPONSIBILITY OF ADDITIONAL DIRECTOR GENERAL OF POLICE SB, ASSAM

The Office of the Additional Director General of Police Special Branch, Assam, is the responsible for the management of the project. Responsibility is presented below:

1. Ensure the formulation of Project Implementation committee.

2. To appoint a Nodal Officer to represent the Additional Director General of Police

Special Branch, Assam and provide all State level support for smooth state wide implementation of the Project

3. To ensure timely sign-offs

4. To ensure timely release of the payments as agreed in the payment terms

5. To take steps to mitigate any such potential risks that might surface during the course of the project

7.2 RESPONSIBILITY OF NIC, ASSAM

The NIC Assam shall support the Additional Director General Police, Special

Branch, Assam, in smooth project implementation and shall build-up necessary capacities to manage the project on an on-going basis. The NIC will apprise the

Additional Director General of Police, Special Branch, Assam, SB the project status in a time bound manner. They will look into issues including Strategic Control,

Adherence to Standards, Security Issues and leveraging of e-Infrastructure. The NIC

Assam will undertake the design, development of the Office automation software in consultation with the Additional Director General of Police Special Branch, Assam,

SB, Assam. The SI has to help in hiring the required manpower as per the

NIC/NICSI standard. NIC Assam will also in turn do the necessary training for capacity building within the SB, Assam. The selected bidder (SI) has to handhold

NIC in carrying out this exercise in a time bound manner.

8.14 PROPOSED SOLUTION SPECIFICATION

1. The proposed architecture of the solution is a browser based front end with the applications residing on application servers and accessed through Intranet and
