17. WARRANTY

Seller's obligations with respect to claims under this warranty shall be limited, at seller's option, either to the repla cement of defecti ve or non-conforming product or to an appropriate credit fo r the pu rchase pric e there of subject to the p rovision s of seller 's Warr anty Polic y as am ended from time to time, sa id Polic y being incorporated herein by reference.

Return Material Authorization Number issued by seller. Buyer remains respon sible for p ayment fo r produ cts not ac cepted f or warran ty adjus tment, han dling c osts, and f reight c osts assoc iated therewith.

Notwithstanding the foregoing, no warranty shall be e nforcea ble in the event th at produc t has been subjected to environmental or stress testing by buyer or any third party without writ ten approval of seller prior to such testin g. Furt her, no wa rranty shall be enforceable if the al leged defect is found to have occurred because of misuse, ne glect, i mproper in stallati on, repair, alteration, accident, or improper return handling procedure by buyer.

Discontinued product is warranted only for a credit or replacement at seller's option.

Notwithstanding the foregoing, if any produc t covered by order(s) placed hereunder is designated as “developm ental,” “prototype” or “experimental,” no warranty whatsoever except a warranty of title to component materials, will be applicable thereto and buyer shall indemnify seller for any claims for liability asserted seller in connection therewith.

The foregoing state the entire liability of seller in connection with products supplied hereunder.
